       Introduced  by  Sen.  LANZA  -- read twice and ordered printed, and when
         printed to be committed to the Committee on Transportation
       AN ACT to authorize the governor to enter into  an  agreement  with  the
         state of New Jersey and apply to the Congress of the United States for
         its  consent and approval, relating to requiring the port authority of
         New York and New Jersey to provide advance notice of  any  project  or
         operation which is expected to impede the flow of traffic
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The governor is authorized to  enter  into  a  supplemental
    2  compact  or  agreement,  on  behalf  of the state, with the state of New
    3  Jersey amending the compact between this state  and  the  state  of  New
    4  Jersey  establishing  the port of New York authority, in accordance with
    5  chapter 154 of the laws of 1921, as amended and supplemented, to  imple-
    6  ment the provisions of section three of this act.
    7    S  2.  The governor is authorized to apply, on behalf of the state, to
    8  the Congress of the United States for its consent and  approval  of  the
    9  amendments to the compact between the state and the state of New Jersey,
   10  establishing  the  port of New York authority, proposed in section three
   11  of this act. Provided, however, that in the absence of the  consent  and
   12  approval  of the Congress, the port authority of New York and New Jersey
   13  shall retain all of the powers which this state and  the  state  of  New
   14  Jersey may confer upon such authority without such consent and approval.
   15    S  3.  The  port  authority  of  New York and New Jersey shall provide
   16  advance notice of any planned project or operation which is expected  to
   17  impede  the  free flow of traffic on or near any port authority facility
   18  by:
   19    a. providing advance written notice to the mayor and  municipal  emer-
   20  gency  management coordinator in every municipality within five miles of
   21  the facility;

    1    b. providing advance notification of the project or operation to news-
    2  papers of general circulation in each county and municipality  in  which
    3  the transportation facility is located; and
    4    c.  using  variable message signs to inform motorists of any operation
    5  which is expected to impede the free flow of traffic.
    6    S 4. This act shall take effect upon the enactment  into  law  by  the
    7  state  of  New  Jersey of legislation having an identical effect as this
    8  act; but if the state of New Jersey  shall  already  have  enacted  such
    9  legislation,  this  act shall take effect immediately; provided that the
   10  governor shall notify the legislative bill drafting commission upon  the
   11  occurrence  of the enactment of the legislation provided for in sections
   12  one, two and three of this act, in order that such commission may  main-
   13  tain  an accurate and timely effective data base of the official text of
   14  the laws of the state of New York in  furtherance  of  effectuating  the
   15  provisions  of section 44 of the legislative law and section 70-b of the
   16  public officers law.
