       AN ACT to amend the public authorities law, in relation to  the  imposi-
         tion of tolls and surcharges for certain bridges and tunnels
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The public authorities law  is  amended  by  adding  a  new
    2  section 553-h-1 to read as follows:
    3    S 553-H-1. BRIDGE CROSSINGS AND TUNNELS; SURCHARGE. 1. NO TOLL CHARGED
    4  BY  THE  AUTHORITY  FOR  CROSSINGS  OVER AN AUTHORITY BRIDGE OR USING AN
    5  AUTHORITY TUNNEL SHALL BE INCREASED ON OR AFTER JANUARY FIRST, TWO THOU-
    6  SAND ELEVEN, PROVIDED, HOWEVER, THAT NOTHING IN THIS  SECTION  SHALL  BE
    7  CONSTRUED  TO  PROHIBIT OR OTHERWISE LIMIT THE AUTHORITY FROM IMPOSING A
    8  SURCHARGE IN ADDITION TO THE REGULAR TOLL CHARGED FOR CROSSINGS OVER  AN
    9  AUTHORITY BRIDGE OR USING AN AUTHORITY TUNNEL.
   10    2.  IN THE EVENT THE AUTHORITY SHALL IMPOSE A SURCHARGE IN ADDITION TO
   11  THE REGULAR TOLL FOR CROSSINGS OVER AN  AUTHORITY  BRIDGE  OR  USING  AN
   12  AUTHORITY TUNNEL, SUCH SURCHARGE SHALL NOT BE DEEMED A PART OF THE REGU-
   13  LAR  FARE,  AND  THE  TOKENS  OFFERED  FOR  SALE  SHALL ALSO ENTITLE THE
   14  PURCHASER TO AN EXEMPTION FROM THE PAYMENT OF ANY SUCH SURCHARGE  IN  AN
   15  AMOUNT EQUAL TO THE AMOUNT OF ANY SUCH SURCHARGE IMPOSED DURING CALENDAR
   16  YEARS  TWO  THOUSAND  ELEVEN THROUGH TWO THOUSAND THIRTEEN.  APPLICATION
   17  FOR SUCH TOKENS OR OTHER PAYMENT DEVICES SHALL BE MADE IN SUCH MANNER AS
   18  PRESCRIBED BY THE AUTHORITY AND SHALL CONTAIN SUCH  INFORMATION  AS  THE
   19  AUTHORITY MAY REASONABLY REQUIRE.
   20    S  2.  Subparagraph  (i)  of paragraph (b) of subdivision 2 of section
   21  1219-a of the public authorities law, as amended by section 19 of part O
   22  of chapter 61 of the laws of 2000, is amended to read as follows:
   23    (i) [twenty-four] SEVENTY-TWO million dollars PLUS AN AUTOMATIC ANNUAL
   24  INCREASE EQUAL TO ANY INCREASE AS  DETERMINED  BY  THE  AVERAGE  MONTHLY
   25  CONSUMER PRICE INDEX FOR THE NEW YORK, NEW YORK-NORTHEASTERN, NEW JERSEY
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1  AREA,  BASED  UPON  THE INDEX FOR ALL URBAN CONSUMERS (CPI-U) DURING THE
    2  PRECEDING TWELVE MONTH PERIOD plus [fifty percentum] SEVENTY PER  CENTUM
    3  of  the  balance  of  such  operating  surplus shall be allocable to the
    4  authority, and
    5    S 3.  This act shall take effect immediately.
