       AN ACT to amend the  environmental  conservation  law,  in  relation  to
         prohibiting  the  taking of northern or lined seahorses for commercial
         purposes
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The environmental conservation law is amended by adding a
    2  new section 13-0310 to read as follows:
    3  S 13-0310. NORTHERN OR LINED SEAHORSES; PROHIBITED ACTS.
    4    1. NO PERSON SHALL TAKE ANY NORTHERN OR  LINED  SEAHORSE  (HIPPOCAMPUS
    5  ERECTUS) FOR COMMERCIAL PURPOSES.
    6    2.  THE  PROVISIONS OF SUBDIVISION ONE OF THIS SECTION SHALL NOT APPLY
    7  TO THE TAKING  OF  SEAHORSES  FOR  SCIENTIFIC  OR  EDUCATIONAL  PURPOSES
    8  INCLUDING, BUT NOT LIMITED TO, PUBLIC OR NOT-FOR-PROFIT ZOOS AND AQUARI-
    9  UMS, AS DETERMINED BY THE COMMISSIONER.
   10    S  2.  This  act shall take effect on the ninetieth day after it shall
   11  have become a law.
