KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to excluding child sexual abuse from the definition of the crime of incest THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The first undesignated paragraph of section 255.25 of the 2 penal law, as amended by chapter 320 of the laws of 2006, is amended to 3 read as follows: 4 A person is guilty of incest in the third degree when he or she 5 marries or engages in sexual intercourse, oral sexual conduct or anal 6 sexual conduct with [a person] AN ADULT whom he or she knows to be 7 related to him or her, whether through marriage or not, as an ancestor, 8 descendant, brother or sister of either the whole or the half blood, 9 uncle, aunt, nephew or niece. 10 S 2. This act shall take effect on the first of November next succeed- 11 ing the date on which it shall have become a law.
