         printed to be committed to the Committee on Consumer Protection
       AN ACT to amend the general business law, in relation to prohibiting the
         sale or rental of indecent material near a school or place of worship
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  397-b to read as follows:
    3    S  397-B. SALE OF INDECENT MATERIAL NEAR A SCHOOL OR PLACE OF WORSHIP.
    4  IT SHALL BE UNLAWFUL FOR ANY PERSON, FIRM OR CORPORATION TO SELL,  OFFER
    5  FOR  SALE,  RENT,  OFFER  TO  RENT  OR  TO DISPLAY INDECENT MATERIAL, AS
    6  DEFINED IN SUBDIVISION ONE OF SECTION 235.21 OF THE  PENAL  LAW,  WITHIN
    7  TWO  HUNDRED  FEET OF ANY PUBLIC OR PRIVATE PRIMARY OR SECONDARY SCHOOL,
    8  CHURCH, SYNAGOGUE, OR OTHER PLACE OF WORSHIP.
    9    S 2. This act shall  take  effect  on  the  first  of  September  next
   10  succeeding the date on which it shall have become a law.
