       AN  ACT  to  amend  the  general  business law, in relation to marijuana
         themed candy
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  399-j to read as follows:
    3    S  399-J.  MARIJUANA  THEMED  CANDY. 1. NO CANDY OR CONFECTION SOLD IN
    4  THIS STATE SHALL BE PACKAGED, SHAPED OR MANUFACTURED TO  RESEMBLE  MARI-
    5  JUANA OR MARIJUANA PRODUCTS OR TO IMITATE THE FLAVOR OF MARIJUANA.
    6    2.  A  VIOLATION OF THE PROVISIONS OF THIS SECTION SHALL BE PUNISHABLE
    7  BY A FINE OF NOT MORE THAN ONE THOUSAND DOLLARS OR A TERM  OF  IMPRISON-
    8  MENT OF UP TO ONE YEAR, OR BOTH SUCH FINE AND IMPRISONMENT.
    9    S 2. This act shall take effect on the first of November next succeed-
   10  ing the date on which it shall have become a law.
