STATE OF NEW YORK ________________________________________________________________________ 1218 2023-2024 Regular Sessions IN SENATE January 10, 2023 ___________ Introduced by Sens. COMRIE, MANNION -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the executive law, in relation to the appointment for agricultural representation on the state fire prevention and building code council The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 374 of the executive law, as added 2 by chapter 707 of the laws of 1981, the opening paragraph as amended by 3 chapter 309 of the laws of 1996, paragraph a as amended by chapter 374 4 of the laws of 2022, and subdivision c as amended by chapter 920 of the 5 laws of 1985, is amended to read as follows: 6 1. There is hereby created and established in the department of state 7 a council, to be known as the state fire prevention and building code 8 council. Such council shall consist of the secretary of state, as chair- 9 man, the state fire administrator and [fifteen] sixteen other members to 10 be appointed as follows: 11 a. Two members, to be appointed by the governor, from among the 12 commissioners of the departments of economic development, environmental 13 conservation, corrections and community supervision, education, health, 14 labor, mental health and social services, office of general services, 15 division of housing and community renewal, the president of the New York 16 state energy research and development authority, and the superintendent 17 of financial services. 18 b. Six members, to be appointed by the governor, one of whom shall be 19 an elected official of a city with a population over one million, one of 20 whom shall be an elected official of another city with a population over 21 one hundred thousand, one of whom shall be an elected official of any 22 other city, one of whom shall be an elected county official, one of whom EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD03305-01-3S. 1218 2 1 shall be an elected town official, and one of whom shall be an elected 2 village official. 3 c. Seven members, to be appointed by the governor with the advice and 4 consent of the senate, one of whom shall be a fire service official, one 5 of whom shall be a registered architect, one of whom shall be a profes- 6 sional engineer, one of whom shall be a code enforcement official, one 7 of whom shall represent builders, one of whom shall represent trade 8 unions, and one of whom shall be a person with a disability as defined 9 in section two hundred ninety-two of this chapter who would directly 10 benefit from the provisions of article thirteen of the state uniform 11 fire prevention and building code. The registered architect and profes- 12 sional engineer shall be duly licensed to practice their respective 13 professions in the state of New York. After the certification of code 14 enforcement personnel pursuant to this chapter shall have begun said 15 code enforcement official shall be so certified. 16 d. One member, to be appointed by the governor, from the state's larg- 17 est agricultural advocacy organization. 18 § 2. This act shall take effect immediately.
