STATE OF NEW YORK ________________________________________________________________________ 928 2017-2018 Regular Sessions IN SENATE January 5, 2017 ___________ Introduced by Sen. CROCI -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the family court act, in relation to ensuring that the probation department receives a copy of an order of protection The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 168 of the family court act is amended by adding a 2 new subdivision 2-a to read as follows: 3 2-a. In any proceeding in which an order of protection has been issued 4 under this section, the clerk of the court shall ensure that a copy of 5 the order of protection is transmitted to the supervising probation 6 department or department of corrections and community supervision where 7 the defendant is under probation or parole, if applicable. The clerk of 8 the court shall be provided access to criminal history record informa- 9 tion maintained by the division of criminal justice services for 10 purposes of effectuating this subdivision. 11 § 2.
