        Introduced  by  Sen. KENNEDY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Children and Families
        AN ACT to amend the social services law, in relation  to  directing  the
          council  on  children  and families to establish an online listing and
          map of publicly funded or registered afterschool and school age  child
          care  programs  and to expand the duties of the commissioner of social
          services; and to amend the education law, in relation to expanding the
          duties of the commissioner of education
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. The social services law is amended by adding a new section
     2  483-h to read as follows:
     3    § 483-h. List of child care providers.  1. The council, in  accordance
     4  with  information  made  available  to  it by the office of children and
     5  family services pursuant  to  section  seventeen  of  this  chapter  and
     6  provided  to  it  by  the state education department pursuant to section
     7  three hundred five of the education law, shall develop and  make  avail-
     8  able through a link on its website:
     9    (a) a listing of:
    10    (1)  all  recipients  of competitive grants awarded or administered by
    11  the state for the  purpose  of  providing:  (i)  afterschool  or  summer
    12  programs as defined in section two of this chapter, or extended learning
    13  time,  including  but  not  limited  to grants for such purposes awarded
    14  under section thirty-six hundred forty-one of the education law; or (ii)
    15  community schools, including but not limited to grants for such purposes
    16  awarded under section thirty-six hundred forty-one of the education law;
    17  and
    18    (2) all registered school age child care providers registered  by  the
    19  office of children and family services; and
    20    (b) a map displaying the locations of the award recipients and provid-
    21  ers described in subparagraph one of paragraph (a) of this subdivision.

     1    2.  The listing shall include for each grant recipient or provider the
     2  recipient's or provider's name, the address  at  which  the  program  is
     3  offered,  and  the name and phone number of an individual who is author-
     4  ized to answer questions regarding the program.
     5    3.  The  listing  and map described in subdivision one of this section
     6  shall be updated no less than once a year. The  listing  and  map  shall
     7  also  be  updated within ninety days of the date of execution or expira-
     8  tion of contracts with grant recipients  when  all  such  contracts  are
     9  executing or expiring for a particular competitive grant.
    10    4.  The  council  may include locations and information for additional
    11  relevant programs as it sees fit.
    12    § 2.  Subdivision (h) of section 17 of the  social  services  law,  as
    13  added  by  section  1  of  part k3 of chapter 57 of the laws of 2007, is
    14  amended to read as follows:
    15    (h) make available on its website all award  allocations  for  request
    16  for  proposals issued by the office of children and family services upon
    17  release of such awards. Such information shall also include  all  organ-
    18  izations  requesting  funding and the amounts requested for each request
    19  for proposal. The office  of  children  and  family  services  may  also
    20  include  any  other  information  related  to each program that it deems
    21  appropriate[.];
    22    § 3. Subdivisions (i) and (j) of section 17  of  the  social  services
    23  law,  subdivision (j) as relettered by section 1 of part W of chapter 54
    24  of the laws of 2016, are relettered subdivisions (j) and (k).
    25    § 3-a. Section 17 of the social services law is amended  by  adding  a
    26  new subdivision (i) to read as follows:
    27    (i)  make  available  to the council on children and families, through
    28  the OpenNY website, information regarding: (1) all recipients of  grants
    29  awarded  or  administered  by  the  state  for the purposes of providing
    30  afterschool or summer programs as defined in section two of  this  chap-
    31  ter,  extended  learning  time,  including but not limited to grants for
    32  such purposes awarded under section thirty-six hundred forty-one of  the
    33  education law, or community schools, including but not limited to grants
    34  for  such purposes awarded under section thirty-six hundred forty-one of
    35  the education law; and (2) registered school age  child  care  providers
    36  registered by the office of children and family services. For each grant
    37  recipient or provider the recipient's or provider's name, the address at
    38  which  the program is offered, and the name and phone number of an indi-
    39  vidual who is authorized to answer questions regarding the program  will
    40  be  made  available  through the OpenNY website no less than once a year
    41  and within ninety days  of  the  date  of  execution  or  expiration  of
    42  contracts with grant recipients when all such contracts are executing or
    43  expiring for a particular competitive grant; and
    44    §  4.  Section  305  of  the  education law is amended by adding a new
    45  subdivision 56 to read as follows:
    46    56. The commissioner shall provide to  the  council  on  children  and
    47  families,  in  a format identified by the council, information regarding
    48  all recipients of grants awarded or administered by the  state  for  the
    49  purposes  of  providing  afterschool  or  summer  programs as defined in
    50  section two of the social services law, extended learning time,  includ-
    51  ing  but  not  limited to grants for such purposes awarded under section
    52  thirty-six hundred forty-one of  this  chapter,  or  community  schools,
    53  including  but  not  limited  to  grants for such purposes awarded under
    54  section thirty-six hundred forty-one of this  chapter.  For  each  grant
    55  recipient or provider the recipient's or provider's name, the address at
    56  which  the program is offered, and the name and phone number of an indi-

     1  vidual who is authorized to answer questions regarding the program  will
     2  be  provided  to  the council no less than once a year and within ninety
     3  days of the date of execution or  expiration  of  contracts  with  grant
     4  recipients  when  all  such  contracts  are  executing or expiring for a
     5  particular competitive grant.
     6    § 5. Section 2 of the social services law is amended by adding two new
     7  subdivisions 39 and 40 to read as follows:
     8    39. "Afterschool program" shall mean a program conducted  outside  the
     9  regular school day whereby students can participate in enrichment activ-
    10  ities  including but not limited to athletics, academic enrichment, art,
    11  music, drama,  academic  tutoring,  mentoring,  community  services  and
    12  related  programs that will promote positive youth development, physical
    13  and/or  emotional  wellness,  educational  achievement,  and/or  school,
    14  civic, family and community engagement.
    15    40.  "Summer program" shall mean a program conducted outside the regu-
    16  lar school year whereby students can participate  in  enrichment  activ-
    17  ities  including but not limited to athletics, academic enrichment, art,
    18  music, drama,  academic  tutoring,  mentoring,  community  services  and
    19  related  programs that will promote positive youth development, physical
    20  and/or  emotional  wellness,  educational  achievement,  and/or  school,
    21  civic,  family  and community engagement, and shall not include required
    22  summer school programming pursuant to section thirty-six hundred two  of
    23  the education law.
    24    §  6.  This  act shall take effect on the ninetieth day after it shall
    25  have become a law; provided that the amendments to subdivisions (i)  and
    26  (j)  of  section  17 of the social services law made by section three of
    27  this act shall not affect the repeal of such subdivisions and  shall  be
    28  deemed repealed therewith.
