STATE OF NEW YORK ________________________________________________________________________ 481--A 2015-2016 Regular Sessions IN SENATE (Prefiled) January 7, 2015 ___________ Introduced by Sen. DIAZ -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services -- recom- mitted to the Committee on Social Services in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the social services law, in relation to providing notice to applicants of potential liability for public assistance benefits The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The social services law is amended by adding a new section 2 110-b to read as follows: 3 § 110-b. Recovery from a person discovered to have property; notice 4 and informed consent. Notwithstanding any law, rule or regulation to 5 the contrary, an applicant for public assistance shall be fully 6 informed, orally and in writing, that he or she may be liable to reim- 7 burse the state for public assistance benefits received, as provided for 8 in this title. Such applicant shall sign an acknowledgment form, 9 provided by the office of temporary and disability assistance, separate 10 from other application-related forms, and the local department shall 11 keep such acknowledgment form in such applicant's file; provided, howev- 12 er, that production of such form shall not be required for the recovery 13 of public welfare benefits. Nothing in this section shall be deemed to 14 prevent the local social services district from maintaining its records 15 electronically. 16 § 2. This act shall take effect on June 30, 2017.
