       AN ACT to amend the penal law, in relation to the promotion of prostitu-
         tion
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Section 230.15 of the penal law is amended by adding a new
    2  subdivision 3 to read as follows:
    3    3. "PROMOTE PROSTITUTION." A PERSON "PROMOTES PROSTITUTION" WHEN HE OR
    4  SHE  KNOWINGLY, ISSUES, GIVES, MAILS, DISTRIBUTES OR TRANSMITS ANY WRIT-
    5  TEN MATERIAL OR ELECTRONIC COMMUNICATION WHICH ADVERTISES THE  PROVISION
    6  OF SEXUAL CONDUCT IN RETURN FOR A FEE.
    7    S 2. Section 230.20 of the penal law, as amended by chapter 627 of the
    8  laws of 1978, is amended to read as follows:
    9  S 230.20 Promoting prostitution in the fourth degree.
   10    A person is guilty of promoting prostitution in the fourth degree when
   11  he OR SHE knowingly advances, PROMOTES or profits from prostitution.
   12    Promoting prostitution in the fourth degree is a class [A misdemeanor]
   13  E FELONY.
   14    S 3. This act shall take effect on the first of November next succeed-
   15  ing the date on which it shall have become a law.
