STATE OF NEW YORK ________________________________________________________________________ 291 2017-2018 Regular Sessions IN SENATE (Prefiled) January 4, 2017 ___________ Introduced by Sen. MURPHY -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend the mental hygiene law, in relation to psychological assessments of employees who have regular contact with persons with developmental disabilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The mental hygiene law is amended by adding a new section 2 16.39 to read as follows: 3 § 16.39 Individualized psychological assessment of employees. 4 Every provider of services who contracts with or is approved or other- 5 wise authorized by the office to provide services to the developmentally 6 disabled shall require the completion of an individualized psychological 7 assessment of each employee who will have regular contact with the 8 clients of such provider. 9 § 2. This act shall take effect on the first of January next succeed- 10 ing the date on which it shall have become a law.
