       AN ACT to amend the public health law, in relation to patient  notifica-
         tion  of services provided by non-participating providers at a partic-
         ipating hospital
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  public health law is amended by adding a new section
    2  2805-u to read as follows:
    3    S 2805-U. NOTIFICATION OF NON-PARTICIPATING PROVIDERS PROVIDING TREAT-
    4  MENT AT A PARTICIPATING HOSPITAL. EVERY HOSPITAL SHALL  BE  REQUIRED  TO
    5  NOTIFY A PATIENT ADMITTED TO SUCH HOSPITAL IF A PHYSICIAN OR HEALTH CARE
    6  PROVIDER  PROVIDING  TREATMENT  TO  SUCH  PATIENT IS NOT A PARTICIPATING
    7  PROVIDER IN THE NETWORK OF ANY INSURER WHOSE PLANS OR POLICIES OF INSUR-
    8  ANCE ARE ACCEPTED BY SUCH HOSPITAL. THE NOTIFICATION  REQUIRED  BY  THIS
    9  SECTION  SHALL BE PRIOR TO SUCH PHYSICIAN OR HEALTH CARE PROVIDER TREAT-
   10  ING THE PATIENT.
   11    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   12  have become a law.
