STATE OF NEW YORK ________________________________________________________________________ 181 2023-2024 Regular Sessions IN SENATE (Prefiled) January 4, 2023 ___________ Introduced by Sens. JACKSON, SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to who may visit local correctional facilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 500-j of the correction law, as amended by chapter 2 291 of the laws of 2009, is amended to read as follows: 3 § 500-j. Who may visit local correctional facilities. The following 4 persons may visit at pleasure all local correctional facilities: The 5 governor and lieutenant-governor, secretary of state, comptroller and 6 attorney-general, members of the legislature and their accompanying 7 staff as requested by the member of the legislature if the member 8 requests to be so accompanied, members of the elected legislative body 9 of the county in which the local correctional facility is located and 10 their accompanying staff as requested by the member of such legislative 11 body if the member requests to be so accompanied, in the city of New 12 York, members of the city council and their accompanying staff as 13 requested by the city council member if the council member requests to 14 be so accompanied, provided that such request does not impact upon the 15 local correctional facility's ability to supervise, manage and control 16 its facilities as determined by the sheriff of the county, or in the 17 counties within the city of New York, the commissioner of correction of 18 such city, or in the county of Westchester, the commissioner of 19 correction of such county, judges of the court of appeals, justices of 20 the supreme court and county judges, district attorneys and every cler- 21 gyman or minister, as such terms are defined in section two of the reli- 22 gious corporations law, having charge of a congregation in the county in 23 which such facility is located. No other person not otherwise authorized EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01331-02-3S. 181 2 1 by law shall be permitted to enter the rooms of a local correctional 2 facility in which convicts are confined, unless under such regulations 3 as the sheriff of the county, or in counties within the city of New 4 York, the commissioner of correction of such city, or in the county of 5 Westchester, the commissioner of correction of such county shall 6 prescribe. 7 § 2. This act shall take effect immediately.
