STATE OF NEW YORK ________________________________________________________________________ 10802 IN ASSEMBLY July 11, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. M. L. Mill- er) -- read once and referred to the Committee on Local Governments AN ACT to authorize the county of Nassau to discontinue use of certain lands as parkland located in the county's Bay Park and to authorize the city of Long Beach to convey to the county of Nassau an easement through land located in the city's Veteran's Memorial Park The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act, the county of 2 Nassau, acting by and through its county legislature, is hereby author- 3 ized to discontinue the use as parklands the lands described in section 4 five of this act, for the purpose of constructing, installing, operating 5 and maintaining a force main from the city of Long Beach to the Bay Park 6 sewage treatment plant. Upon completion of the force main related 7 construction, the county of Nassau shall restore the surface of the 8 lands more particularly described in section five of this act and the 9 lands shall continue to be used for park purposes. 10 § 2. Subject to the provisions of this act, the city of Long Beach, 11 acting by and through its city council, is hereby authorized to discon- 12 tinue the use as parklands the lands described in section six of this 13 act and convey by appropriate instrument an easement to such lands to 14 the county of Nassau, for the purpose of enabling the county to 15 construct, install, operate and maintain a sewage force main from the 16 city of Long Beach to the Bay Park sewage treatment plant. Upon 17 completion of the force main related construction, the county of Nassau 18 shall restore the surface of the lands more particularly described in 19 section six of this act and the lands shall continue to be used for park 20 purposes. 21 § 3. The authorization provided in section one of this act shall be 22 effective only upon the condition that the county of Nassau dedicate an 23 amount equal to or greater than the fair market value of the parklands 24 being discontinued towards the acquisition of new parklands and/or capi- 25 tal improvements to existing park and recreational facilities. The authorization provided in section two of this act shall be 2 effective only upon the condition that the city of Long Beach dedicate 3 an amount equal to or greater than the fair market value of the park- 4 lands being discontinued towards the acquisition of new parklands and/or 5 capital improvements to existing park and recreational facilities. 6 § 5. In the event that the county of Nassau received any funding 38 support or assistance from the federal government for the purchase, 39 maintenance or improvement of the parklands set forth in section five of 40 this act, the discontinuance and alienation of such parkland authorized 41 by the provisions of this act shall not occur until the county of Nassau 42 has complied with any federal requirements pertaining to the alienation 43 or conversion of parklands, including satisfying the secretary of the 44 interior that the alienation or conversion complies with all conditions 45 which the secretary of the interior deems necessary to assure the 46 substitution of other lands shall be equivalent in fair market value and 47 usefulness to the lands being alienated or converted. 48 § 8. In the event that the city of Long Beach received any funding 49 support or assistance from the federal government for the purchase, 50 maintenance or improvement of the parklands set forth in section six of 51 this act, the discontinuance and alienation of such parkland authorized 52 by the provisions of this act shall not occur until the city of Long 53 Beach has complied with any federal requirements pertaining to the 54 alienation or conversion of parklands, including satisfying the secre- 55 tary of the interior that the alienation or conversion complies with all 56 conditions which the secretary of the interior deems necessary to assureA. 10802 5 1 the substitution of other lands shall be equivalent in fair market value 2 and usefulness to the lands being alienated or converted. 3 § 9. This act shall take effect immediately.
