Santabar- bara) -- read once and referred to the Committee on Mental Health -- reported and referred to the Committee on Ways and Means -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the mental hygiene law, in relation to establishing the autism spectrum disorders advisory board The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The mental hygiene law is amended by adding a new section 2 13.42 to read as follows: 3 § 13.42 Autism spectrum disorders advisory board. 4 (a) There is hereby established within the office the autism spectrum 5 disorders advisory board. Such board shall consist of nineteen members, 6 ten of whom shall be appointed and nine of whom shall serve ex officio. 7 Of the ten appointed members, two shall be appointed by the governor, 8 two shall be appointed by the temporary president of the senate, two 9 shall be appointed by the speaker of the assembly, two shall be 10 appointed by the minority leader of the senate and two shall be 11 appointed by the minority leader of the assembly. Of the two members 12 appointed by each appointing authority, one member shall have expertise 13 of work as a professional in the field of autism and one member shall be 14 a family advocate or self-advocate in the community that such advocate 15 resides. A representative from each of the following state agencies 16 shall serve ex officio: the office for people with developmental disa- 17 bilities; the department of education; the office of mental health; the 18 office of children and family services; the department of health; the 19 developmental disabilities planning council; the council on children and 20 families; and the office of vocational and educational services for 21 individuals with disabilities. The chair of the board shall be selected 22 by the governor. 23 (b) Members of the board shall serve at the pleasure of the appointing 24 authority. Vacancies on the board shall be filled in the same manner as 25 the original appointment. LBD15753-03-6A. 10558--A 2 1 sation, but may be reimbursed for actual and necessary expenses incurred 2 in the performance of their duties within amounts appropriated therefor. 3 (c) The board shall have the following tasks and duties: 4 (1) Study and review the effectiveness of supports and services 5 currently being provided to people diagnosed with autism spectrum disor- 6 ders; 7 (2) Identify legislative and regulatory activity which may be required 8 to improve existing service systems that support people diagnosed with 9 autism spectrum disorders; 10 (3) Identify methods of improving interagency coordination of services 11 and maximize the impact and effectiveness of services and agency func- 12 tions; and 13 (4) Such other matters as may be deemed appropriate by the members of 14 the board. 15 At the discretion of the chair, the board may consult with stakehold- 16 ers for the purpose of carrying out its tasks and duties in accordance 17 with this subdivision. 18 (d) Such board shall meet at least quarterly. Special meetings may be 19 called by the chair. The agenda and meeting place of all regular or 20 special meetings shall be made available to the public in advance of 21 such meetings. 22 (e) The advisory board shall submit a written report to the governor, 23 the temporary president of the senate and the speaker of the assembly by 24 no later than October first of the year next succeeding the effective 25 date of this section and annually thereafter, setting forth the recom- 26 mendations and activities of the council on matters within the scope of 27 its duties as set forth in this section. 28 § 2. This act shall take effect immediately.
