STATE OF NEW YORK ________________________________________________________________________ 10555 IN ASSEMBLY May 4, 2018 ___________ Introduced by M. of A. QUART -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law and the administrative code of the city of New York, in relation to the number of traffic-control signal photo violation-monitoring devices and photo speed violation monitoring systems authorized to be installed and operating within the city of New York The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph 1 of subdivision (a) of section 1111-a of the 2 vehicle and traffic law, as amended by chapter 18 of the laws of 2009, 3 is amended to read as follows: 4 1. Notwithstanding any other provision of law, each city with a popu- 5 lation of one million or more is hereby authorized and empowered to 6 adopt and amend a local law or ordinance establishing a demonstration 7 program imposing monetary liability on the owner of a vehicle for fail- 8 ure of an operator thereof to comply with traffic-control indications in 9 such city in accordance with the provisions of this section. Such demon- 10 stration program shall empower a city to install and operate traffic- 11 control signal photo violation-monitoring devices [at no more than one12hundred fifty intersections] within such city [at any one time]. 13 § 2. Paragraph 1 of subdivision (a) of section 1180-b of the vehicle 14 and traffic law, as amended by chapter 43 of the laws of 2014, is 15 amended to read as follows: 16 1. Notwithstanding any other provision of law, the city of New York is 17 hereby authorized to establish a demonstration program imposing monetary 18 liability on the owner of a vehicle for failure of an operator thereof 19 to comply with posted maximum speed limits in a school speed zone within 20 the city (i) when a school speed limit is in effect as provided in para- 21 graphs one and two of subdivision (c) of section eleven hundred eighty 22 of this article or (ii) when other speed limits are in effect as 23 provided in subdivision (b), (d), (f) or (g) of section eleven hundred 24 eighty of this article during the following times: (A) on school days 25 during school hours and one hour before and one hour after the school EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Such demonstration program shall empower 4 the city to install photo speed violation monitoring systems within [no5more than one hundred forty] school speed zones within the city [at any6one time] and to operate such systems within such zones (iii) when a 7 school speed limit is in effect as provided in paragraphs one and two of 8 subdivision (c) of section eleven hundred eighty of this article or (iv) 9 when other speed limits are in effect as provided in subdivision (b), 10 (d), (f) or (g) of section eleven hundred eighty of this article during 11 the following times: (A) on school days during school hours and one hour 12 before and one hour after the school day, and (B) a period during 13 student activities at the school and up to thirty minutes immediately 14 before and up to thirty minutes immediately after such student activ- 15 ities. In selecting a school speed zone in which to install and operate 16 a photo speed violation monitoring system, the city shall consider 17 criteria including, but not limited to the speed data, crash history, 18 and the roadway geometry applicable to such school speed zone. 19 § 3. Paragraph 1 of subdivision (a) of section 1180-b of the vehicle 20 and traffic law, as added by chapter 189 of the laws of 2013, is amended 21 to read as follows: 22 1. Notwithstanding any other provision of law, the city of New York is 23 hereby authorized to establish a demonstration program imposing monetary 24 liability on the owner of a vehicle for failure of an operator thereof 25 to comply with posted maximum speed limits in a school speed zone within 26 the city (i) when a school speed limit is in effect as provided in para- 27 graphs one and two of subdivision (c) of section eleven hundred eighty 28 of this article or (ii) when other speed limits are in effect as 29 provided in subdivision (b), (d), (f) or (g) of section eleven hundred 30 eighty of this article during the following times: (A) on school days 31 during school hours and one hour before and one hour after the school 32 day, and (B) a period during student activities at the school and up to 33 thirty minutes immediately before and up to thirty minutes immediately 34 after such student activities. Such demonstration program shall empower 35 the city to install photo speed violation monitoring systems within [no36more than twenty school speed zones within] the city [at any one time] 37 and to operate such systems within such zones (iii) when a school speed 38 limit is in effect as provided in paragraphs one and two of subdivision 39 (c) of section eleven hundred eighty of this article or (iv) when other 40 speed limits are in effect as provided in subdivision (b), (d), (f) or 41 (g) of section eleven hundred eighty of this article during the follow- 42 ing times: (A) on school days during school hours and one hour before 43 and one hour after the school day, and (B) a period during student 44 activities at the school and up to thirty minutes immediately before and 45 up to thirty minutes immediately after such student activities. In 46 selecting a school speed zone in which to install and operate a photo 47 speed violation monitoring system, the city shall consider criteria 48 including, but not limited to the speed data, crash history, and the 49 roadway geometry applicable to such school speed zone. 50 § 4. Paragraph 1 of subdivision (a) of section 19-210 of the adminis- 51 trative code of the city of New York, as amended by chapter 18 of the 52 laws of 2009, is amended to read as follows: 53 1. Notwithstanding any other provision of law, the parking violations 54 bureau is hereby authorized and empowered to establish a demonstration 55 program imposing monetary liability on the owner of a vehicle for fail- 56 ure of an operator thereof to comply with traffic-control indications inA. 10555 3 1 accordance with the provisions of this section. The department of trans- 2 portation, for purposes of implementation of such program, shall be 3 authorized to install and operate traffic-control signal photo viola- 4 tion-monitoring devices [at no more than one hundred fifty intersections5at any one time] within the city. 6 § 5. This act shall take effect immediately; provided, however, that 7 the amendments to section 1111-a of the vehicle and traffic law made by 8 section one of this act shall not affect the repeal of such section and 9 shall be deemed repealed therewith; provided further, however that the 10 amendments to paragraph 1 of subdivision (a) of section 1180-b of the 11 vehicle and traffic law made by section two of this act shall not affect 12 the expiration and reversion of such paragraph pursuant to section 12 of 13 chapter 43 of the laws of 2014, as amended, when upon such date section 14 three of this act shall take effect; provided further, however, that the 15 amendments to section 1180-b of the vehicle and traffic law made by 16 sections two and three of this act shall not affect the repeal of such 17 section and shall be deemed repealed therewith; and provided further, 18 however, that the amendments to section 19-210 of the administrative 19 code of the city of New York made by section four of this act shall not 20 affect the expiration of such section and shall be deemed to expire 21 therewith.
