        AN ACT to amend the general business law, in relation to the  recall  of
          class B firefighting foam that contains intentionally added PFAS

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (b) of subdivision 4  of  section  391-u  of  the
     2  general  business  law,  as  added by chapter 88 of the laws of 2020, is
     3  amended to read as follows:
     4    (b) A manufacturer that [produces, sells, or distributes] at any  time
     5  produced,  sold,  or distributed a class B firefighting foam [prohibited
     6  under subdivision three of this  section]  that  contains  intentionally
     7  added  PFAS  shall  recall  all of the product, [which includes] sold or
     8  otherwise distributed prior to or after March twenty-second,  two  thou-
     9  sand  twenty-two.  This  shall  entail collection, transport, treatment,
    10  storage and safe disposal, within two  years  after  the  implementation
    11  date  of the restrictions set forth in subdivision three of this section
    12  and reimburse the retailer or any other purchaser for the product.
    13    § 2.  This act shall take effect immediately.
