STATE OF NEW YORK ________________________________________________________________________ 10428 IN ASSEMBLY May 26, 2016 ___________ Introduced by M. of A. ENGLEBRIGHT, OTIS, FAHY, SIMANOWITZ -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to elec- tronic waste The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 27-2603 of the environmental 2 conservation law is amended by adding a new paragraph (d-1) to read as 3 follows: 4 (d-1) Notwithstanding paragraph (d) of this subdivision, for calendar 5 years two thousand seventeen and two thousand eighteen the statewide 6 recycling or reuse goal for all electronic waste shall be the product of 7 the latest population estimate for the state, as published by the United 8 States census bureau multiplied by seven pounds. 9 § 2. Subdivision 4 of section 27-2603 of the environmental conserva- 10 tion law is amended by adding a new paragraph (c) to read as follows: 11 (c) The department shall annually notify each manufacturer of its 12 acceptance standard for the following calendar year by October first. 13 § 3. Paragraphs (a), (b) and (c) of subdivision 5 of section 27-2603 14 of the environmental conservation law, as added by chapter 99 of the 15 laws of 2010, are amended to read as follows: 16 (a) If a manufacturer accepts at least ninety percent but less than 17 one hundred percent of its manufacturer's acceptance standard as 18 required by subdivision four of this section, the surcharge shall be 19 [thirty] sixty cents multiplied by the number of additional pounds of 20 electronic waste that should have been accepted by such manufacturer. 21 (b) If a manufacturer accepts at least fifty percent but less than 22 ninety percent of its manufacturer's acceptance standard as required by 23 subdivision four of this section, the surcharge shall be [forty] eighty 24 cents multiplied by the number of additional pounds of electronic waste 25 that should have been accepted by such manufacturer. 26 (c) If a manufacturer accepts less than fifty percent of its manufac- 27 turer's acceptance standard as required by subdivision four of this 28 section, the surcharge shall be [fifty cents] one dollar multiplied by EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
