       AN ACT to amend the administrative code of the  city  of  New  York,  in
         relation to outdoor tire storage
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 2501.3 of FC 2501 of the New York city fire code of
    2  chapter 2 of title 29 of the administrative code  of  the  city  of  New
    3  York,  as  added  by local law number 26 of the city of New York for the
    4  year 2008, is amended to read as follows:
    5    2501.3 General. Tire rebuilding plants, tire storage and  tire  bypro-
    6  duct facilities shall be designed, operated and maintained in accordance
    7  with this chapter, NFPA 13, NFPA 231D, and if applicable, Chapter 23. IN
    8  ADDITION, MOTOR VEHICLE REPAIR SHOPS, AS DEFINED IN SECTION 398-B OF THE
    9  VEHICLE  AND  TRAFFIC  LAW,  SHALL COMPLY WITH THE PROVISIONS OF SECTION
   10  2505 OF THIS CHAPTER WITH REGARD TO THE OUTDOOR STORAGE AND PLACEMENT OF
   11  TIRES.
   12    S 2. Section 2505.4 of FC 2505 of the New York city fire code of chap-
   13  ter 2 of title 29 of the administrative code of the city of New York, as
   14  added by local law number 26 of the city of New York for the year  2008,
   15  is  amended  and two new sections 2505.8 and 2505.9 are added to read as
   16  follows:
   17    2505.4 Distance from lot lines and buildings. Tire storage piles shall
   18  be located at least 50 feet (15 240 mm) from lot  lines  and  buildings,
   19  INCLUDING RESIDENTIAL BUILDINGS unless the commissioner approves a less-
   20  er  separation  distance  of  tire  storage piles in accordance with the
   21  criteria set forth in NFPA 231D.
   22    2505.8 PUBLIC WAY RESTRICTIONS. NO TIRE STORAGE PILE SHALL BE  LOCATED
   23  OR PLACED ON ANY PUBLIC WAY.
   24    2505.9  TIRE  DISPLAY  RACKS.  ALL TIRE STORAGE RACKS FOR TIRE DISPLAY
   25  SHALL BE MADE OF NON-COMBUSTIBLE MATERIALS.
   26    S 3. This act shall take effect immediately.
