       AN  ACT  to  amend  the  public  officers  law, in relation to including
         providers of services to the  developmentally  disabled  that  receive
         state funding under the purview of the freedom of information law
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 3 of section 86 of the public officers law,  as
    2  added by chapter 933 of the laws of 1977, is amended to read as follows:
    3    3.  "Agency"  means  any state or municipal department, board, bureau,
    4  division, commission, committee, public authority,  public  corporation,
    5  council,  office  or other governmental entity performing a governmental
    6  or proprietary function for the state or any one or more  municipalities
    7  thereof,  except the judiciary or the state legislature.  "AGENCY" SHALL
    8  ALSO INCLUDE PROVIDERS OF SERVICES TO THE DEVELOPMENTALLY DISABLED OPER-
    9  ATING UNDER AN OPERATING CERTIFICATE PURSUANT TO ARTICLE  THIRTY-ONE  OF
   10  THE MENTAL HYGIENE LAW AND FUNDED BY THE STATE.
   11    S 2. This act shall take effect on the one hundred twentieth day after
   12  it  shall have become a law. Effective immediately, the addition, amend-
   13  ment and/or repeal of any rule or regulation necessary for the implemen-
   14  tation of this act on its effective date is authorized to be made on  or
   15  before such date.
