        AN ACT to amend the vehicle and traffic law, in relation to  creating  a
          pedestrian safety rating system for motor vehicles

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
     2  section 216-b to read as follows:
     3    § 216-b. Pedestrian safety rating system. The commissioner shall cause
     4  to  be  created  a  pedestrian  safety rating system which shall be made
     5  publicly available on the department's internet website. Such pedestrian
     6  safety rating system shall provide a rating between one and  five  stars
     7  for  every  motor  vehicle model registered by individuals in this state
     8  based on:
     9    1. the frequency of collisions involving  a  bicyclist  or  pedestrian
    10  reported  in  the  state  for  such motor vehicle model, compared to the
    11  total number of such motor vehicle model registered in the state;
    12    2. safety features that the commissioner determines  are  relevant  to
    13  pedestrian and bicyclist safety, including but not limited to, automatic
    14  collision  warning  or pedestrian detection features, automatic braking,
    15  and visibility; and
    16    3. any other factors  the  commissioner  determines  are  relevant  to
    17  pedestrian and bicyclist safety.
    18    § 2. This act shall take effect immediately.
