       AN  ACT  to amend the executive law, in relation to requiring that three
         percent of all  state  contracts  be  procured  to  veteran-owned  and
         service-disabled veteran-owned businesses
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  The executive law is amended by adding a new  section  369
    2  to read as follows:
    3    S 369. STATE CONTRACT OPPORTUNITIES FOR VETERAN-OWNED AND SERVICE-DIS-
    4  ABLED  VETERAN-OWNED  BUSINESSES. 1. FOR THE PURPOSES OF THIS SECTION, A
    5  "VETERAN-OWNED AND SERVICE-DISABLED VETERAN-OWNED BUSINESS" SHALL MEAN A
    6  BUSINESS THAT IS: (A) FIFTY-ONE PERCENT OWNED BY A VETERAN AND  (B)  HAS
    7  AN ANNUAL GROSS SALES OF LESS THAN SEVENTY-FIVE MILLION DOLLARS.
    8    2.  THE  DIRECTOR  SHALL PROMULGATE RULES AND REGULATIONS THAT PROVIDE
    9  MEASURES AND PROCEDURES TO ENSURE THAT THREE  PERCENT  OF  TOTAL  ANNUAL
   10  STATEWIDE  PROCUREMENT  OF STATE CONTRACTS BE AWARDED TO ELIGIBLE VETER-
   11  AN-OWNED AND SERVICE-DISABLED VETERAN-OWNED BUSINESSES.
   12    3. THE DIRECTOR SHALL ENSURE THAT EACH CONTRACTING AGENCY  ADMINISTERS
   13  THE RULES AND REGULATIONS PROMULGATED IN ACCORDANCE WITH SUBDIVISION TWO
   14  OF THIS SECTION.
   15    S 2. This act shall take effect immediately.
