       AN ACT to amend the administrative code of the  city  of  New  York,  in
         relation  to  amending  the penalty for unlawfully fleeing a uniformed
         officer of the New York city taxi and limousine commission
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraph  1  of  subdivision  e of section 19-506 of the
    2  administrative code of the city of New  York,  as  added  by  local  law
    3  number  32 of the city of New York for the year 2012, is amended to read
    4  as follows:
    5    (1) In addition to or as an alternative to the penalties provided  for
    6  the  violation of the provisions of paragraph one of subdivision b [or],
    7  subdivision d, OR SUBDIVISION L of this section, any  person  who  shall
    8  violate  such provisions shall, for the first violation, be liable for a
    9  civil penalty of one thousand five hundred dollars, and for  the  second
   10  violation committed within a [thirty six] THIRTY-SIX month period, for a
   11  civil penalty of two thousand dollars.
   12    S 2. Subdivision l of section 19-506 of the administrative code of the
   13  city  of New York, as added by chapter 9 of the laws of 2012, is amended
   14  to read as follows:
   15    l. A person is guilty of [unlawful] UNLAWFULLY  fleeing  [a  New  York
   16  city  taxi  and limousine] AN enforcement officer OF THE COMMISSION or A
   17  police officer when, knowing that he or she has been directed to  remain
   18  stopped  by  [a New York city taxi and limousine] AN enforcement officer
   19  OF THE COMMISSION or A police officer, the driver of a vehicle  [operat-
   20  ing  pursuant to a HAIL license who is stopped in a zone where he or she
   21  is not permitted to pick up street hails]  LICENSED  BY  THE  COMMISSION
   22  thereafter attempts to flee such officer ON FOOT OR by setting the vehi-
   23  cle  in  motion  and either [travels] TRAVELLING over three hundred feet
   24  without stopping or [engages] ENGAGING in conduct constituting  reckless
   25  driving  as  defined in section twelve hundred twelve of the vehicle and
   26  traffic law. [Unlawful] UNLAWFULLY fleeing [a New  York  city  taxi  and
   27  limousine]  AN enforcement officer OF THE COMMISSION or A police officer
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

    1  is a misdemeanor punishable by a fine of not less  than  [seven  hundred
    2  fifty] ONE THOUSAND dollars nor more than [one] TEN thousand dollars, or
    3  by  imprisonment of not more than [ninety] ONE HUNDRED TWENTY days or by
    4  both such fine and imprisonment.  Notwithstanding any contrary provision
    5  of  law,  any  charge  alleging a violation of this subdivision shall be
    6  returnable before a court having jurisdiction over misdemeanors.
    7    S 3. This act shall take effect immediately.
