        AN  ACT  to  amend  the  social  services  law, in relation to assisting
          persons with clinical/symptomatic HIV illness or AIDS
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Section 2 of the social services law is amended by adding a
     2  new subdivision 41 to read as follows:
     3    41.  "Person with clinical/symptomatic HIV illness or AIDS" shall mean
     4  a person who has at any time been  diagnosed  with  clinical/symptomatic
     5  HIV  illness,  as  determined by the New York state department of health
     6  AIDS institute, or a person with AIDS, as defined by the federal centers
     7  for disease control and prevention.
     8    § 2. Subdivision 14 of section 131-a of the social  services  law,  as
     9  added  by  section  1  of  part  H of chapter 58 of the laws of 2014, is
    10  amended to read as follows:
    11    14. In determining the  need  for  aid  provided  pursuant  to  public
    12  assistance  programs,  each  person living with clinical/symptomatic HIV
    13  illness or AIDS [in social services districts  with  a  population  over
    14  five  million] who is receiving [services through such district's admin-
    15  istrative unit  providing  HIV/AIDS  services,]  public  assistance  and
    16  earned  and/or  unearned  income, shall not be required to pay more than
    17  thirty percent of his or  her  monthly  earned  and/or  unearned  income
    18  toward the cost of rent that such person has a direct obligation to pay;
    19  this provision shall not apply to room and board arrangements.
    20    §  3.  Section 131 of the social services law is amended by adding two
    21  new subdivisions 21 and 22 to read as follows:
    22    21. When necessary, each local social services district  shall  assist
    23  persons  with  clinical/symptomatic  HIV  illness or AIDS (i) secure the
    24  required documentation to determine  eligibility  for  assistance,  (ii)
    25  arrange for required face-to-face interviews to be conducted during home
    26  visits  or  at other appropriate sites, and (iii) by providing referrals
    27  for services as well as other resources and materials  as  described  in
    28  subdivision twenty-two of this section.

     1    22.  The  office, in consultation with the department of health, shall
     2  create, maintain, and periodically update information  on  the  office's
     3  website regarding resources and services throughout the state, including
     4  the  location  of  such services, which shall include but not be limited
     5  to,  community  based  supports,  employment  opportunities, and medical
     6  professionals   specialized   in    assisting    such    persons    with
     7  clinical/symptomatic  HIV  illness  or AIDS, to be utilized by the local
     8  social services districts. Such information shall also be made available
     9  on the office's website.
    10    § 4. This act shall take effect on the ninetieth day  after  it  shall
    11  have become a law.
