STATE OF NEW YORK ________________________________________________________________________ 9653 IN ASSEMBLY January 31, 2020 ___________ Introduced by M. of A. L. ROSENTHAL -- read once and referred to the Committee on Tourism, Parks, Arts and Sports Development AN ACT to establish a temporary state commission to rename any projects, infrastructure, facilities or sites within the state which are named after or include any reference to Robert Moses; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The commissioner of the New York state office of parks, 2 recreation and historic preservation, is hereby authorized to create a 3 temporary state commission, hereafter referred to as the commission, to 4 rename any projects, infrastructure, facilities or sites within the 5 state which are named after or include any reference to Robert Moses, 6 including, but not limited to, statues, schools, parks, playgrounds, 7 roadways and beaches. 8 § 2. (a) The commission shall consist of seven members, to be 9 appointed as follows: one member to be appointed by the governor; three 10 members to be appointed by the temporary president of the senate, 11 consisting of two members from the majority party and one member from 12 the minority party; and three members to be appointed by the speaker of 13 the assembly, consisting of two members from the majority party and one 14 member from the minority party. Each member appointed pursuant to this 15 section shall be one of a local official, civic leader or park official. 16 Vacancies in the membership of the commission and among its officers 17 shall be filled in the manner provided for original appointments or 18 designations. Such appointments shall be made within six months of the 19 effective date of this act. 20 (b) All departments or agencies of the state or subdivisions thereof 21 shall, at the request of the commission, provide such facilities, 22 assistance, and data as will enable the commission to carry out its 23 powers and duties. 24 § 3. (a) For the accomplishment of its purposes, the commission may 25 meet and hold public and/or private hearings within or without the state 26 and shall have all the powers of a legislative committee pursuant to the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The commission is authorized to consult with community 2 leaders and empowered to undertake any studies, inquiries, surveys or 3 analyses it may deem relevant through its own personnel or in cooper- 4 ation with or by agreement with any other public or private agency. The 5 commission shall consult with other departments or agencies of the state 6 or subdivisions thereof as necessary when the renaming of a project, 7 piece of infrastructure, facility or site involves such other depart- 8 ments or agencies of the state or subdivisions thereof. 9 (b) To the maximum extent feasible, the commission may request and 10 shall be entitled to receive and shall utilize and be provided with such 11 facilities, resources and data from any court in the state and from any 12 subdivision, department, board, bureau, commission, office, agency or 13 other instrumentality of the state or of any political subdivision ther- 14 eof as it deems necessary or desirable for the proper execution of its 15 powers and duties and to effectuate the purposes set forth in this act. 16 (c) The commission is hereby authorized and empowered to enter into 17 any agreements and to do and perform any acts that may be necessary, 18 desirable or proper to carry out the purposes and objectives of this 19 act. 20 § 4. (a) The commission shall make and submit their name recommenda- 21 tions to the commissioner of the New York state office of parks, recre- 22 ation and historic preservation, the temporary president of the senate 23 and the speaker of the assembly. Such recommendations shall be made 24 within six months after all members of the commission have been 25 appointed pursuant to paragraph (a) of section two of this act. 26 (b) Once such recommendations are received and decided upon, the 27 commissioner of the New York state office of parks, recreation and 28 historic preservation shall take all necessary steps to proceed with 29 such renaming. Where applicable, the commissioner shall work in conjunc- 30 tion with other departments or agencies of the state or subdivisions 31 thereof to proceed with such renaming. 32 § 5. This act shall take effect immediately and shall expire and be 33 deemed repealed on the first date next succeeding the date of the renam- 34 ing of all projects, infrastructure, facilities or sites within the 35 state which are named after or include any reference to Robert Moses as 36 required under this act; and provided further, however, that the commis- 37 sioner of the New York state office of parks, recreation and historic 38 preservation shall notify the legislative bill drafting commission upon 39 the renaming of all projects, infrastructure, facilities or sites within 40 the state which are named after or include any reference to Robert Moses 41 as required under this act in order that the commission may maintain an 42 accurate and timely effective data base of the official text of the laws 43 of the state of New York in furtherance of effecting the provisions of 44 section 44 of the legislative law and section 70-b of the public offi- 45 cers law.
