STATE OF NEW YORK ________________________________________________________________________ 9641 IN ASSEMBLY January 30, 2018 ___________ Introduced by M. of A. MAYER -- read once and referred to the Committee on Codes AN ACT to amend the civil practice law and rules, in relation to requir- ing that certain subpoenas be served with a separate informational sheet that summarizes why the subpoena has been issued The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1311-a of the civil practice law and rules is 2 amended by adding a new subdivision 7 to read as follows: 3 7. Any subpoena issued pursuant to this section and in relation to an 4 action commenced under article sixteen of the election law shall require 5 that the subpoena be served with a separate informational sheet that 6 summarizes why the subpoena has been issued, that the case is not 7 related to a criminal action, that the person to whom the subpoena is 8 being served does not currently face criminal charges related to the 9 case, specify that the action is related to the upcoming election of the 10 pertinent office and the consequences of not following the subpoena. 11 The informational sheet shall be affixed to the subpoena being served 12 and shall be written in plain language and printed in a format and type 13 size that is clear and easy to read. 14 § 2. This act shall take effect on the ninetieth day after it shall 15 have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13644-01-7
