MAGEE, FINCH -- read once and referred to the Committee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee -- again reported from said committee with amendments, ordered reprinted as amended and recommitted to said committee AN ACT in relation to authorizing the use of sewer surplus for infras- tructure projects other than sewer projects in the Village of Sher- burne and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding section 453 of the general municipal law 2 or any other provision of law to the contrary, the village of Sherburne 3 is hereby authorized to use surplus revenues derived from sewer rents 4 collected in excess of amounts necessary for the uses described in 5 section 453 of the general municipal law for the payment of expenses or 6 obligations incurred by such municipality for infrastructure improve- 7 ments, or to be placed in a capital reserve fund, not to exceed forty 8 percent of the surplus to be used specifically for infrastructure 9 improvements. The village of Sherburne shall adjust their sewer rents, 10 and take other actions as may be necessary, to avoid future sewer rent 11 surpluses. 12 S 2. This act shall take effect on the sixtieth day after it shall 13 have become a law and shall expire and be deemed repealed one year after 14 such date.
