ROSENTHAL -- read once and referred to the Committee on Agriculture AN ACT to amend the agriculture and markets law and the general business law, in relation to veterinarian examination THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph (c) of subdivision 5 of section 401 of the agri- 2 culture and markets law, as amended by chapter 110 of the laws of 2012, 3 is amended to read as follows: 4 (c) Within five business days of receipt, but prior to sale of any dog 5 OR CAT, the pet dealer shall have a duly licensed veterinarian conduct 6 an examination and tests appropriate to the age and breed to determine 7 if the animal has any medical conditions apparent at the time of the 8 examination that adversely affect the health of the animal. For animals 9 eighteen months of age or older, such examination shall include a diag- 10 nosis of any congenital conditions that adversely affect the health of 11 the animal. Any animal diagnosed with a contagious disease shall be 12 treated and caged separately from healthy animals. 13 S 2. Subdivision 1 of section 753-a of the general business law, as 14 amended by chapter 110 of the laws of 2012, is amended to read as 15 follows: 16 1. Within five business days of receipt, but prior to the sale of any 17 dog OR CAT, the pet dealer shall have a duly licensed veterinarian 18 conduct an examination and tests appropriate to the breed and age to 19 determine if the animal has any medical conditions apparent at the time 20 of the examination that adversely affect the health of the animal. For 21 animals eighteen months of age or older, such examination shall include 22 a diagnosis of any congenital conditions that adversely affect the 23 health of the animal. Any animal diagnosed with a contagious disease 24 shall be treated and caged separately from healthy animals in accordance 25 with section four hundred one of the agriculture and markets law. 26 S 3.
