       AN ACT to amend chapter 330 of the laws of 2011 amending the  town  law,
         relating  to  payments  for certain school, fire, fire protection, and
         ambulance districts for lands exempt from real property  taxation  for
         purposes  which implement the Peconic Bay community preservation fund,
         and permitting the town  of  Southampton  to  make  such  payments  in
         certain cases, in relation to payments to libraries
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 2 of chapter 330 of the laws of 2011, amending  the
    2  town   law,   relating  to  payments  for  certain  school,  fire,  fire
    3  protection, and ambulance districts for lands exempt from real  property
    4  taxation  for purposes which implement the Peconic Bay community preser-
    5  vation fund, and  permitting  the  town  of  Southampton  to  make  such
    6  payments in certain cases, is amended to read as follows:
    7    S 2. Notwithstanding any provision of law to the contrary, the town of
    8  Southampton  may  make  annual  payments from its community preservation
    9  fund to certain high-tax school, fire, fire  protection,  and  ambulance
   10  districts,  as  specified  in  this  section,  located  either wholly or
   11  partially within the central Pine Barrens area as defined in subdivision
   12  10 of section 57-0107 of  the  environmental  conservation  law.    Such
   13  payments  may  be  made  to mitigate the impact of the lost tax revenues
   14  from lands made wholly exempt as a result of their  acquisition  by  the
   15  federal,  state,  or  local government for the preservation of community
   16  character as defined in subdivision 4 of section 64-e of the  town  law.
   17  The  following  districts  shall  be  eligible: Riverhead central school
   18  district, Hampton Bays union free school district, Eastport-South  Manor
   19  central   school   district,  Riverhead  fire  district,  Flanders  fire
   20  district, Flanders - Northampton ambulance district, and the  North  End

    1  Quogue  fire  protection district.   FOR THE PURPOSES OF THIS SECTION, A
    2  PAYMENT SHALL ALSO BE  MADE  TO  A  LIBRARY  WHERE  AN  ELIGIBLE  SCHOOL
    3  DISTRICT LEVIES TAXES ON BEHALF OF SUCH LIBRARY.
    4    S  2. This act shall take effect immediately, provided that the amend-
    5  ments to section 2 of chapter 330 of the laws of 2011, made  by  section
    6  one of this act shall not affect the repeal of such section and shall be
    7  deemed to be repealed therewith.
