       AN ACT to amend the mental hygiene law, in relation  to  examination  of
         persons  ordered  to  obtain assisted outpatient treatment in counties
         with a population of less than seventy-five thousand
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.    Paragraph  4  of subdivision (e) of section 9.60 of the
    2  mental hygiene law, as added by chapter 158 of  the  laws  of  2005,  is
    3  amended to read as follows:
    4    (4)  In counties with a population of less than seventy-five thousand,
    5  the affirmation or affidavit required by paragraph three of this  subdi-
    6  vision may be made by a physician who is an employee of the office.  The
    7  office  is  authorized AND DIRECTED to make available, at no cost to the
    8  county, a qualified physician for the purpose of making such affirmation
    9  or affidavit consistent with the provisions of such paragraph.
   10    S 2. This act shall take effect immediately, provided,  however,  that
   11  the amendments made to paragraph 4 of subdivision (e) of section 9.60 of
   12  the  mental  hygiene law by section one of this act shall not affect the
   13  repeal of such section and shall be deemed repealed therewith.
