RAMOS -- read once and referred to the Committee on Real Property Taxation AN ACT to amend the real property tax law, in relation to limiting base proportion of the 2009-2010 assessment roll in the school districts in the town of Islip with special equalization rates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The opening paragraph of subparagraph (iv) of paragraph (a) 2 of subdivision 3 of section 1903 of the real property tax law is desig- 3 nated clause 1 and a new clause 2 is added to read as follows: 4 (2) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, IN A SCHOOL DISTRICT 5 IN THE TOWN OF ISLIP WITH SPECIAL EQUALIZATION RATES AND FOR CURRENT 6 BASE PROPORTIONS TO BE DETERMINED BY TAXES BASED ON SUCH SCHOOL 7 DISTRICT'S TWO THOUSAND NINE - TWO THOUSAND TEN ASSESSMENT ROLLS, THE 8 CURRENT BASE PROPORTION OF ANY CLASS SHALL NOT EXCEED THE ADJUSTED BASE 9 PROPORTION OR ADJUSTED PROPORTION, WHICHEVER IS APPROPRIATE, OF THE 10 IMMEDIATELY PRECEDING YEAR BY MORE THAN ONE PERCENT. WHERE THE COMPUTA- 11 TION OF CURRENT BASE PROPORTIONS WOULD OTHERWISE PRODUCE SUCH RESULT, 12 THE CURRENT BASE PROPORTION OF SUCH CLASS OR CLASSES SHALL BE LIMITED TO 13 SUCH ONE PERCENT INCREASE, AND THE LEGISLATIVE BODY OF SUCH SCHOOL 14 DISTRICT SHALL ALTER THE CURRENT BASE PROPORTION OF EITHER CLASS SO 15 THAT THE SUM OF THE CURRENT BASE PROPORTIONS EQUALS ONE. 16 S 2.
