       AN  ACT  authorizing the game of poker at the Belmont Park racetrack and
         one off-track betting simulcast facility per county
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Game of poker. 1. The game of poker shall be permitted at
    2  the Belmont Park racetrack and all off-track betting  simulcast  facili-
    3  ties not to exceed one per county.
    4    2.  For  purposes  of  this act, the game of poker is a game of skill,
    5  played in accordance with the house rules as established by an organiza-
    6  tion authorized by the state racing and wagering board and  approved  by
    7  the  state  racing  and  wagering  board  and shall be defined as "texas
    8  holdem".
    9    3. a. Where the poker game is contest style, there shall be  an  entry
   10  fee  into  each  poker  game  where  a  percentage  of such fee shall be
   11  retained by the racetrack or off-track betting simulcast  facility  with
   12  the remaining amount going into a pool for prizes.
   13    b.  Where  the  poker  game  is  free play, the racetrack or off-track
   14  betting simulcast facility shall keep a percentage of each hand with the
   15  remaining amount going to the winner.
   16    4. The state racing and wagering board shall be  the  oversight  board
   17  for poker wagering in the state.
   18    5.  All  rules  and  regulations that apply to cashiers or tellers for
   19  racetracks and off-track betting simulcast facilities shall apply to all
   20  poker dealers.
   21    6. The racetrack or off-track betting simulcast facility shall  retain
   22  thirty  percent  of  the  amount  collected or withheld from the game of
   23  poker, twenty percent shall go to the state and fifty percent  shall  be
   24  directed  to  the  county  in  which  the racetrack or off-track betting
   25  simulcast facility is located.

    1    7. The hours of operation shall run in the same manner  as  the  video
    2  lottery terminals.
    3    8.  The  state  racing and wagering board, division of the lottery and
    4  the department of taxation and finance shall promulgate rules and  regu-
    5  lations  necessary  for  the  establishment and operation of the game of
    6  poker authorized pursuant to subdivision one of this section, including,
    7  but not limited to any leases and/or licenses to the operation  of  such
    8  facilities.
    9    S 2. This act shall take effect immediately.
