        AN ACT to amend the military law, in relation to age requirements appli-
          cable to appointments or promotions of public employees who have  been
          absent on military duty

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 10-a of section 243 of  the  military  law,  as
     2  separately  amended  by chapter 484 of the laws of 2019 and a chapter of
     3  the laws of 2019, amending the military law relating to age requirements
     4  applicable to appointments or promotions of public  employees  who  have
     5  been  absent  on military duty, as proposed in legislative bills numbers
     6  S. 6483 and A. 8348, is amended to read as follows:
     7    10-a. Age requirements. If maximum age requirements are established by
     8  law, or rule or by action of a civil commission for examination for,  or
     9  for appointment or promotion to, any position in the public service, the
    10  period  of  military duty as hereinbefore defined, the period of service
    11  after June twenty-seventh, nineteen hundred fifty,  voluntarily  entered
    12  upon between January first, nineteen hundred forty-seven, and June twen-
    13  ty-seventh,  nineteen  hundred  fifty,  if  such service otherwise falls
    14  within the definition of military duty, and the period of terminal leave
    15  granted by the military authorities of a candidate or eligible shall not
    16  be included in computing the age of such candidate or eligible  for  the
    17  purposes  of  such  examination  or  appointment or promotion; provided,
    18  however, that neither shall the total time deducted hereunder in comput-
    19  ing the age of a candidate or eligible exceed seven years[, except that]
    20  for any position including, but not limited to, in cities with  a  popu-
    21  lation of one million or more[, the total time deducted shall not exceed
    22  seven years].
    23    §  2.  This  act  shall  take  effect on the same date and in the same
    24  manner as a chapter of the laws of 2019, amending the  military  law  in
    25  relation to age requirements applicable to appointments or promotions of
    26  public  employees  who have been absent on military duty, as proposed in
    27  legislative bills numbers S. 6483 and A. 8348, takes effect.
