STATE OF NEW YORK ________________________________________________________________________ 8964 IN ASSEMBLY January 9, 2018 ___________ Introduced by M. of A. D'URSO -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the time period for state environmental quality review The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 8-0107 of the environmental conservation law, as 2 added by chapter 612 of the laws of 1975, is amended to read as follows: 3 § 8-0107. Agency implementation. 4 All agencies shall review their present statutory authority, adminis- 5 trative regulations, and current policies and procedures for the purpose 6 of determining whether there are any deficiencies or inconsistencies 7 therein which prohibit full compliance with the purposes and provisions 8 of this article, and shall recommend or effect such measures as may be 9 necessary to bring their authority and policies into conformity with the 10 intent, purposes, and procedures set forth in this article. They shall 11 carry out its terms with minimum procedural and administrative delay, 12 shall avoid unnecessary duplication of reporting and review requirements 13 by providing, where feasible, for combined or consolidated proceedings, 14 and shall expedite all proceedings hereunder in the interests of prompt 15 review. Time periods set forth in this article or established pursuant 16 to regulation shall be mandatory and are not subject to any period of 17 extension unless the applicant or project sponsor agrees to a period of 18 extension. 19 § 2.
