ABINANTI, SANTABARBARA, DINOWITZ, GONZALEZ-ROJAS, AUBRY, ENGLEBRIGHT, GOTTFRIED, SIMON, HUNTER, CAHILL, COOK, SILLITTI, SAYEGH -- read once and referred to the Committee on Education -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT providing that a student enrolled in an individualized education program during certain school years may continue to receive educa- tional services until the student completes the services pursuant to the individualized education program or turns twenty-three years old, whichever is sooner; and to provide for the repeal of such provisions upon the expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any provision of law, rule or regulation to 2 the contrary, a school district may provide educational services in the 3 2022-23 and 2023-24 school years to a student who turned twenty-one 4 years old during the 2021-22 school year and was enrolled in the school 5 district and receiving special education services pursuant to an indi- 6 vidualized education program. Such student may continue to receive such 7 educational services until the student completes the services pursuant 8 to the individualized education program or turns twenty-three years old, 9 whichever is sooner. 10 § 2. This act shall take effect immediately and shall expire and be 11 deemed repealed June 30, 2024. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
