STATE OF NEW YORK ________________________________________________________________________ 8595 2017-2018 Regular Sessions IN ASSEMBLY July 10, 2017 ___________ Introduced by M. of A. RA -- read once and referred to the Committee on Corporations, Authorities and Commissions AN ACT to amend chapter 54 of the laws of 2016, amending the public authorities law relating to committing the state of New York and the city of New York to partially fund part of the costs of the Metropol- itan Transportation Authority's capital program, in relation to accel- erating the development and installation of advanced signal and commu- nications technologies; and to amend chapter 54 of the laws of 2017, enacting the capital projects budget and chapter 55 of the laws of 2016, enacting the capital projects budget, in relation to funding for the acceleration of the development and installation of advanced signal and communications technologies by the metropolitan transporta- tion authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Legislative intent. The legislature hereby finds that the 2 metropolitan transportation authority has 837 track miles, over 1,600 3 mainline switches and 13,000 signals. While the three most recent 4 metropolitan transportation authority capital plans dedicate more than 5 five billion dollars to signal repair and upgrades, much of this funding 6 is maintaining existing signaling systems, some of which are more than a 7 century old. As ridership reaches highs last seen in the post-World War 8 II years, replacing the signal system must receive the highest priority 9 to ensure a safe, efficient and reliable means of transportation. 10 § 2. Section 1 and subdivision (a) of section 2 of part NN of chapter 11 54 of the laws of 2016, amending the public authorities law relating to 12 committing the state of New York and the city of New York to partially 13 fund part of the costs of the Metropolitan Transportation Authority's 14 capital program, are amended to read as follows: 15 Section 1. This act commits the state of New York (state) and the city 16 of New York (city) to fund, over a multi-year period, $10,828,000,000 in EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13235-01-7A. 8595 2 1 capital costs related to projects contained in the Metropolitan Trans- 2 portation Authority (MTA) 2015-2019 capital program (capital program). 3 The state share of $8,336,000,000 shall consist of $1,000,000,000 in 4 appropriations first enacted in the 2015-2016 state budget and addi- 5 tional funds sufficient for Metropolitan Transportation Authority (MTA) 6 to pay $7,336,000,000 of capital costs as provided [herein] in this act, 7 of which no less than $1,950,000,000 shall be for the costs to acceler- 8 ate the development and installation of advanced signal and communi- 9 cations technologies in connection with commuter railroad and mass tran- 10 sit systems within the metropolitan transportation authority's core 11 capital program. The city share of $2,492,000,000 shall consist of 12 $657,000,000 to be provided by the city from 2015 through 2019, and 13 additional funds sufficient for MTA to pay $1,835,000,000 of capital 14 costs for the capital program. The $7,336,000,000 of additional funds to 15 be provided by the state may be used by the MTA to pay direct capital 16 costs and/or the state may fund such $7,336,000,000 of capital costs 17 through financing mechanisms undertaken by the MTA, provided that no 18 less than $1,950,000,000 shall be for the costs to accelerate the devel- 19 opment and installation of advanced signal and communications technolo- 20 gies in connection with commuter railroad and mass transit systems with- 21 in the metropolitan transportation authority's core capital program. 22 Unless extraordinary circumstances justify otherwise, it is intended 23 that the additional funds committed by the state and city shall be 24 provided concurrently, and in proportion to the respective shares of 25 each, in accordance with the funding needs of the capital program. 26 (a) The additional funds provided by the state pursuant to section one 27 of this act shall be scheduled and made available to pay for the costs 28 of the capital program after MTA capital resources planned for the capi- 29 tal program, not including additional city and state funds, have been 30 exhausted, or when MTA capital resources planned for the capital program 31 are not available. It is anticipated that state funds shall be required 32 by, and provided to, the MTA in an amount to support $1,500,000,000 of 33 capital costs in the first year in which planned MTA capital resources 34 are exhausted; $2,600,000,000 in the second year; $1,840,000,000 in the 35 third year and $1,396,000,000 in the fourth year or thereafter, provided 36 that no less than $1,950,000,000 shall be for the costs to accelerate 37 the development and installation of advanced signal and communications 38 technologies in connection with commuter railroad and mass transit 39 systems within the metropolitan transportation authority's core capital 40 program. 41 § 3. Section 1 of chapter 54 of the laws of 2017, enacting the capital 42 projects budget, is amended by adding thereto the items herein below set 43 forth in italics as follows: 44 METROPOLITAN TRANSPORTATION AUTHORITY 45 CAPITAL PROJECTS 2017-18 46 METROPOLITAN TRANSPORTATION AUTHORITY (CCP) .............. 1,532,200,000 47 -------------- 48 Capital Projects Funds - Other 49 Capital Projects Fund 50 Mass Transit Purpose 51 For the costs of the metropolitan transpor- 52 tation authority's 2015-2019 capitalA. 8595 3 1 program, pursuant to chapter 54 of the 2 laws of 2016 regarding the commitment of 3 the state of New York to fund, over a 4 multi-year period, $7,336,000,000 of capi- 5 tal costs related to such program, of 6 which no less than $1,950,000,000 shall be 7 for the costs to accelerate the develop- 8 ment and installation of advanced signal 9 and communications technologies in 10 connection with commuter railroad and mass 11 transit systems within the metropolitan 12 transportation authority's core capital 13 program. Funds appropriated herein shall 14 be made available in the event that the 15 state elects to meet its commitment 16 through direct payments (26JW17MT) ....... 1,467,200,000 17 § 4. Section 1 of chapter 55 of the laws of 2016, enacting the capital 18 projects budget, as amended by chapter 54, section 1, of the laws of 19 2017, is amended by adding thereto the items hereinbelow set forth in 20 italics as follows: 21 METROPOLITAN TRANSPORTATION AUTHORITY 22 METROPOLITAN TRANSPORTATION AUTHORITY (CCP) 23 Capital Projects Funds - Other 24 Capital Projects Fund 25 Mass Transit Purpose 26 For the costs of the metropolitan transportation authority's 2015-2019 27 capital program, pursuant to chapter 54 of the laws of 2016 regard- 28 ing the commitment of the state of New York to fund, over a multi- 29 year period, $7,336,000,000 of capital costs related to such 30 program, of which no less than $1,950,000,000 shall be for the costs 31 to accelerate the development and installation of advanced signal 32 and communications technologies in connection with commuter railroad 33 and mass transit systems within the metropolitan transportation 34 authority's core capital program.
