        AN ACT to amend the education law, in relation to the scope of the  work
          an athletic trainer is authorized to perform

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 4 of section 8351  of  the  education  law,  as
     2  amended  by  a  chapter  of  the laws of 2023 amending the education law
     3  relating to requiring licensure of athletic  trainers,  as  proposed  in
     4  legislative  bills  numbers S. 942-A and A. 219-A, is amended to read as
     5  follows:
     6    4. The scope of work described  [herein  shall  not  be  construed  as
     7  authorizing  the  management  and  treatment  of  neurological injuries,
     8  conditions, or diseases, except for initial  evaluation  and  triage  of
     9  emergent neurological conditions] in this section shall not be construed
    10  as  authorizing  the  management  and  treatment  of acute, subacute, or
    11  chronic  neurological  pathologies  and  comorbidities  or  neurological
    12  disease  processes.  Athletic  trainers may, however, perform an initial
    13  evaluation and triage of emergent neurological conditions such as poten-
    14  tial concussions, spinal cord injuries or  nerve  injuries  that  result
    15  from  engagement  in  athletic  activity, and following the individual's
    16  clearance by the supervising physician, the athletic  trainer  may  work
    17  with the individual pursuant to the signed written agreement or protocol
    18  to  manage,  monitor and treat concussions and peripheral nerve injuries
    19  in such settings as part of the rehabilitation  to  return  to  athletic
    20  activity subject to the limitations of subdivision one of this section.
    21    §  2.  This  act  shall  take  effect on the same date and in the same
    22  manner as a chapter of the laws  of  2023  amending  the  education  law
    23  relating  to  requiring  licensure  of athletic trainers, as proposed in
    24  legislative bills numbers S. 942-A and A. 219-A, takes effect.
