       AN ACT to amend the  environmental  conservation  law,  in  relation  to
         prohibiting the use of Methoprene
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 33-1301 of the environmental  conservation  law  is
    2  amended by adding a new subdivision 12 to read as follows:
    3    12. FOR ANY PERSON TO USE ANY PESTICIDE CONTAINING THE ACTIVE INGREDI-
    4  ENT  ISOPROPYL(2E, 4E)-11 METHOXY-3, 7, 11 TRIMETHYL-2, 4 DODECADIENOATE
    5  (METHOPRENE) IN ANY STORM DRAIN, CONVEYANCE FOR WATER OR FISH HABITAT IN
    6  ANY MUNICIPALITY ADJOINING THE LONG ISLAND SOUND AND THE ATLANTIC OCEAN,
    7  AND THEIR CONNECTING WATER BODIES, BAYS, HARBORS, SHALLOWS  AND  MARSHES
    8  PROVIDED,  HOWEVER,  AN  EMERGENCY  APPLICATION OF SUCH PESTICIDE MAY BE
    9  MADE AS DETERMINED BY THE COUNTY HEALTH DEPARTMENT IN CASES WHERE  THERE
   10  IS A SIGNIFICANT THREAT TO PUBLIC HEALTH.
   11    S 2. This act shall take effect on January 1, 2016.
