       AN ACT to amend the social services law, in relation  to  the  abandoned
         infant protection program
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 372-g of the social services law, as added by chap-
    2  ter 156 of the laws of 2000, is amended to read as follows:
    3    S 372-g. Abandoned infant protection program. 1. The office  of  chil-
    4  dren  and  family services shall develop and implement a public informa-
    5  tion program to inform the general public of the provisions of the aban-
    6  doned infant protection act. The program may include but not be  limited
    7  to the following elements:
    8    [1.]  (A)  educational  and  informational  materials in print, audio,
    9  video, electronic, or other media;
   10    [2.] (B) public service announcements and advertisements; [and]
   11    [3.] (C) establishment of  toll-free  telephone  hotlines  to  provide
   12  information; AND
   13    (D) SUCH INFORMATION SHALL INCLUDE THE FACT THAT THE PERSON SURRENDER-
   14  ING  THE  INFANT  CAN  CHANGE  HIS  OR  HER  MIND  WITHIN  THE TIMEFRAME
   15  PRESCRIBED BY THE LAW, AND MAY USE THE TOLL-FREE HOTLINE OR OTHER AVAIL-
   16  ABLE MEANS TO RESCIND THEIR DECISION  TO  RECLAIM  THE  INFANT  IF  THEY
   17  CHOOSE TO WITHIN THAT PRESCRIBED TIMEFRAME.
   18    2. THE OFFICE OF CHILDREN AND FAMILY SERVICES SHALL BE PROHIBITED FROM
   19  CONTACTING, THROUGH ANY MEANS OF COMMUNICATION, A PERSON WHO HAS AVAILED
   20  HIMSELF OR HERSELF OF THE PROTECTIONS OF THE ABANDONED INFANT PROTECTION
   21  ACT,  OR WHO HAS OTHERWISE SURRENDERED A CHILD TO THE OFFICE OF CHILDREN
   22  AND FAMILY SERVICES AND OTHER SOCIAL SERVICES AGENCIES WITH  THE  INTENT
   23  OF RELINQUISHING HIS OR HER PARENTAL RIGHTS, UNLESS SUCH PERSON AFFIRMA-
   24  TIVELY INITIATES THE CONTACT.
   25    S 2. This act shall take effect immediately.
