       AN  ACT  to amend the social services law, in relation to implementation
         of a quality based childcare rating system
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  The social services law is amended by adding a new section
    2  483-g to read as follows:
    3    S 483-G. QUALITY BASED CHILDCARE RATING SYSTEM. 1. THE EARLY CHILDHOOD
    4  ADVISORY  COUNCIL  TO  THE CHILDREN'S CABINET, THE CHILDREN'S CABINET AS
    5  CREATED BY EXECUTIVE ORDER 6.16, DATED JUNE TWELFTH, TWO THOUSAND SEVEN,
    6  IN CONSULTATION WITH THE COUNCIL, THE  OFFICE  OF  CHILDREN  AND  FAMILY
    7  SERVICES, THE DEPARTMENT OF EDUCATION AND THE NEW YORK CITY EARLY CHILD-
    8  HOOD  PROFESSIONAL  DEVELOPMENT  INSTITUTE,  SHALL IMPLEMENT THE QUALITY
    9  RATING AND IMPROVEMENT SYSTEM FOR EARLY  CHILDHOOD  PROGRAMS,  KNOWN  AS
   10  QUALITYSTARSNY,  WHICH  SHALL BE MANDATORY FOR EVERY CHILDCARE PROVIDER,
   11  PUBLIC AND PRIVATE NURSERY SCHOOL AND PRE-SCHOOL LICENSED, CERTIFIED  OR
   12  APPROVED BY THE STATE OR ANY LOCAL AGENCY.
   13    2.  THE  OFFICE OF CHILDREN AND FAMILY SERVICES SHALL PROMULGATE RULES
   14  AND REGULATIONS TO IMPLEMENT QUALITYSTARSNY, UTILIZING  THE  INFORMATION
   15  GATHERED  FROM  THE FIELD TEST CONDUCTED BY THE EARLY CHILDHOOD ADVISORY
   16  COUNCIL AND THE NEW YORK CITY EARLY CHILDHOOD  PROFESSIONAL  DEVELOPMENT
   17  INSTITUTE.
   18    S 2. This act shall take effect on the one hundred twentieth day after
   19  it  shall  have  become a law; provided that, effective immediately, the
   20  addition, amendment and/or repeal of any rule  or  regulation  necessary
   21  for  the implementation of this act on its effective date are authorized
   22  and directed to be made and completed on or before such effective date.
