       AN ACT to amend chapter 33 of the laws of 2002, relating to granting the
         commissioner  of  education  and  the  education department additional
         authority over the Roosevelt union free school district,  in  relation
         to making certain technical amendments thereto
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 3 of chapter 33 of the laws of  2002,  relating  to
    2  granting  the  commissioner  of  education  and the education department
    3  additional authority over the Roosevelt union free school  district,  is
    4  amended to read as follows:
    5    S  3.  Additional authority of commissioner of education. 1.  Notwith-
    6  standing any other provision of law, rule, or regulation to the  contra-
    7  ry,  the  commissioner  of education shall have the following powers, in
    8  addition to those currently granted the commissioner under the education
    9  law, and may delegate such powers except where the  provisions  of  this
   10  act  specifically  require  the commissioner to exercise such powers and
   11  duties:
   12    (a) To appoint and supervise the  superintendent  of  schools  of  the
   13  Roosevelt  union  free school district, and to remove the superintendent
   14  in accordance with the terms  and  procedures  in  the  superintendent's
   15  contract,  as  if  such removal were by the board of education, provided
   16  that the power to appoint and remove the  superintendent  shall  not  be
   17  delegated to any other person;
   18    (b)  To  disapprove appointments of assistant or associate superinten-
   19  dents of schools, building principals and other school  administers  and
   20  supervisors, including tenure appointments; and
   21    (c)  To  exercise  fiscal control over the Roosevelt union free school
   22  district in accordance with section four of this act.

    1    2. The commissioner of education shall have the  additional  authority
    2  outlined in this section until June 30, 2011. Provided, however, that if
    3  the  commissioner  of education determines that the Roosevelt union free
    4  school district has not demonstrated sufficient improvement  to  warrant
    5  termination  of  the additional authority, the commissioner of education
    6  shall be authorized to continue to exercise such  authority  until  June
    7  30,  2013.  PROVIDED  FURTHER  THAT AFTER SUCH DATE, THE COMMISSIONER OF
    8  EDUCATION SHALL  ADVISE  AND  GUIDE  THE  ROOSEVELT  UNION  FREE  SCHOOL
    9  DISTRICT  IN  RELATION  TO  ITS DUTIES AND THE GENERAL MANAGEMENT OF THE
   10  SCHOOL DISTRICT PURSUANT TO ARTICLE 7 OF TITLE 1 OF THE  EDUCATION  LAW,
   11  AND SHALL REPORT TO THE GOVERNOR AND THE LEGISLATURE ANNUALLY BY SEPTEM-
   12  BER  FIRST  NEXT FOLLOWING THE END OF THE 2013-2014 AND 2014-2015 SCHOOL
   13  YEARS ON THE ACADEMIC AND FISCAL CONDITION OF THE SCHOOL DISTRICT.
   14    S 2. This act shall take effect immediately.
