        AN ACT to amend the vehicle and traffic law, in relation to establishing
          a  residential  parking  system  in the village of South Nyack, or its
          successor municipality

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 1662-f to read as follows:
     3    § 1662-f. Residential parking system in the village of South Nyack  or
     4  its  successor  municipality. 1.   Notwithstanding the provisions of any
     5  law to the contrary, the board of  trustees  of  the  village  of  South
     6  Nyack, or its successor municipality, may, by adoption of a local law or
     7  ordinance,  provide  for  a  residential  parking permit system to be in
     8  effect on the weekends and holidays  between  April  first  and  October
     9  thirty-first and fix and require the payment of fees applicable to park-
    10  ing within the area in which such parking system is in effect in accord-
    11  ance with the provisions of this section.
    12    2.  Such  residential  parking  permit  system may only be established
    13  within the area of the village consisting of the following roadways:
    14    (a) S. Broadway north from Ferris Lane to Voorhis Avenue;
    15    (b) Depot Place north from Brookside to Voorhis Avenue;
    16    (c) Brookside Ave from Cooper Drive east to S. Broadway;
    17    (d) Clinton Ave from Cooper Drive east to Piermont Avenue;
    18    (e) Voorhis Avenue from Depot Place east to S. Broadway;
    19    (f) Prall Place from S. Broadway east to Piermont Avenue;
    20    (g) Washington Avenue from S. Broadway east to Piermont Avenue;
    21    (h) Mansfield Avenue (south side of the street) from S. Broadway  east
    22  to Piermont Avenue;
    23    (i) Cornelison Avenue from S. Broadway east to Piermont Avenue;
    24    (j) all of Cooper Drive;

     1    (k) all of Elizabeth Place;
     2    (l) all of Hamilton Place;
     3    (m) all of Livingston Place; and
     4    (n) all of White Ave.
     5    3. Notwithstanding the foregoing, no permit shall be required on those
     6  portions  of  such  streets  where the adjacent properties are zoned for
     7  commercial/retail use.
     8    4. The local law or ordinance providing for such  residential  parking
     9  system shall:
    10    (a)  set  forth  factors  necessitating  the enactment of such parking
    11  system;
    12    (b) provide that motor vehicles registered pursuant  to  section  four
    13  hundred  four-a of this chapter shall be exempt from any permit require-
    14  ment;
    15    (c) provide the times of day and days of the week during which  permit
    16  requirements shall be in effect;
    17    (d) make not less than fifteen percent of the spaces within the permit
    18  area  available to nonresidents, and shall provide short term parking of
    19  not less than sixty minutes in duration in the permit area;
    20    (e) require that such residential parking system cannot  only  utilize
    21  an app-based system for payment and shall include metered payment;
    22    (f) provide the schedule of fees to be paid for such permits; and
    23    (g)  provide  that  such fees shall be credited to the general fund of
    24  the village of South Nyack, or its successor municipality, unless other-
    25  wise specified in such local law.
    26    5. No ordinance shall be adopted pursuant  to  this  section  until  a
    27  public  hearing  thereon has been had in the same manner as required for
    28  public hearings on a local law pursuant to the municipal home rule law.
    29    6. The provisions of this section shall not apply to any state highway
    30  maintained by the state.
    31    § 2. This act shall take effect on the one hundred twentieth day after
    32  it shall have become a law. Effective immediately, the addition,  amend-
    33  ment and/or repeal of any rule or regulation necessary for the implemen-
    34  tation  of  this act on its effective date are authorized to be made and
    35  completed on or before such effective date.
