       AN ACT to amend the social services law, in relation to establishing the
         department of health as the agency to provide proof of Medicaid eligi-
         bility  when  requested by a recipient or his or her designated repre-
         sentative
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Section  366-a  of  the social services law is amended by
    2  adding a new subdivision 3-a to read as follows:
    3    3-A. THE DEPARTMENT OF HEALTH SHALL RESPOND TO A REQUEST WITHIN THIRTY
    4  DAYS AND IT SHALL BE THE SINGLE STATE AGENCY REQUIRED TO  PROVIDE  PROOF
    5  OF   ELIGIBILITY  ON  OFFICIAL  DEPARTMENT  OF  HEALTH  LETTERHEAD  WHEN
    6  REQUESTED BY A  RECIPIENT  OR  HIS  OR  HER  DESIGNATED  REPRESENTATIVE,
    7  INCLUDING,  BUT NOT LIMITED TO, LEGAL COUNSEL, LEGAL GUARDIAN, OR ATTOR-
    8  NEY-IN-FACT UNDER A POWER OF ATTORNEY.
    9    S 2. This act shall take effect immediately.
