RIVERA, ROSENTHAL, CORWIN, GABRYSZAK -- read once and referred to the Committee on Governmental Operations -- recommitted to the Committee on Governmental Operations in accord- ance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the state finance law, in relation to membership on the state procurement council THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph a of subdivision 1 of section 161 of the state 2 finance law, as amended by chapter 175 of the laws of 2010, is amended 3 to read as follows: 4 a. The state procurement council shall continuously strive to improve 5 the state's procurement process. Such council shall consist of [twenty] 6 TWENTY-ONE members, including the commissioner, the state comptroller, 7 the director of the budget, the chief diversity officer and the commis- 8 sioner of economic development, or their respective designees; seven 9 members who shall be the heads of other large and small state agencies 10 chosen by the governor, or their respective designees; ONE MEMBER, 11 APPOINTED BY THE GOVERNOR, REPRESENTING A NOT-FOR-PROFIT NEW YORK-BASED 12 ORGANIZATION ENGAGED IN THE MARKETING AND/OR PROMOTION OF NEW YORK GROWN 13 FARM AND AGRICULTURAL PRODUCTS OR A NOT-FOR-PROFIT NEW YORK-BASED ORGAN- 14 IZATION ENGAGED SOLELY IN THE ADVOCACY, MARKETING AND/OR PROMOTION OF 15 ORGANIC NEW YORK GROWN FARM AND AGRICULTURAL PRODUCTS TO BE LIMITED TO A 16 TWO YEAR TERM; and eight at large members appointed as follows: three 17 appointed by the temporary president of the senate, one of whom shall be 18 a representative of local government and one of whom shall be a repre- 19 sentative of private business; three appointed by the speaker of the 20 assembly, one of whom shall be a representative of local government and 21 one of whom shall be a representative of private business; one appointed EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10622-08-2 A. 7515--A 2 1 by the minority leader of the senate; and, one appointed by the minority 2 leader of the assembly; and two non-voting observers appointed as 3 follows: one appointed by the temporary president of the senate and one 4 appointed by the speaker of the assembly. The non-voting observers shall 5 be provided, contemporaneously, all documentation and materials distrib- 6 uted to members. The council shall be chaired by the commissioner and 7 shall meet at least quarterly. 8 S 2. This act shall take effect immediately.
