       AN  ACT to amend the labor law, in relation to permitting the employment
         of minors as referees, umpires or officials at youth sporting events
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 2 of section 130 of the labor law is amended by
    2  adding a new paragraph i to read as follows:
    3    I.  A  MINOR  TWELVE  OR THIRTEEN YEARS OF AGE AS A REFEREE, UMPIRE OR
    4  OFFICIAL AT A YOUTH SPORTING EVENT WHEN ATTENDANCE UPON  INSTRUCTION  IS
    5  NOT REQUIRED BY THE EDUCATION LAW.
    6    S  2.  Paragraph a of subdivision 3 of section 131 of the labor law is
    7  amended by adding a new subparagraph 7 to read as follows:
    8    (7) SERVICE AS A REFEREE, UMPIRE  OR  OFFICIAL  AT  A  YOUTH  SPORTING
    9  EVENT.
   10    S  3.  Paragraph a of subdivision 3 of section 132 of the labor law is
   11  amended by adding a new subparagraph 7 to read as follows:
   12    (7) SERVICE AS A REFEREE, UMPIRE  OR  OFFICIAL  AT  A  YOUTH  SPORTING
   13  EVENT.
   14    S  4.  Subdivision  4  of  section 142 of the labor law, as amended by
   15  chapter 35 of the laws of 2004, is amended to read as follows:
   16    4. This section shall not apply to a newspaper carrier as  defined  in
   17  section thirty-two hundred twenty-eight of the education law whose hours
   18  of  work are governed by such section, a farm laborer, a child performer
   19  whose employment is governed by section 35.01 of the arts  and  cultural
   20  affairs  law  and  article  four-A  of this chapter, a child model whose
   21  employment is governed by section 35.05 of the arts and cultural affairs
   22  law, a bridge caddie at a bridge tournament, A REFEREE, UMPIRE OR  OFFI-
   23  CIAL  AT  A  YOUTH SPORTING EVENT or a baby sitter as defined in section
   24  one hundred thirty-one of this [chapter] ARTICLE.
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1    S 5.  Subdivision 4 of section 143 of the labor  law,  as  amended  by
    2  chapter 35 of the laws of 2004, is amended to read as follows:
    3    4.  This  section shall not apply to a newspaper carrier as defined in
    4  section thirty-two hundred twenty-eight of the education law whose hours
    5  of work are governed by such section, a farm laborer, a child  performer

   13  at a camp for children during the months of June, July and August.
   14    S 6. This act shall take effect immediately.
