SCHIMEL -- read once and referred to the Committee on Real Property Taxation -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to authorize the village of North Hills to file applications for real property tax exemptions with the county of Nassau THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Notwithstanding any other provision of any law to the 2 contrary, the assessor of the county of Nassau is hereby authorized to 3 accept from the incorporated village of North Hills applications for 4 exemption from real property taxes pursuant to section 406 of the real 5 property tax law for the 2008-2009 assessment roll with respect to the 6 pro-rata share of the 2008-2009 school taxes and the pro-rata share of 7 the 2009 general taxes, and for the 2009-2010 assessment roll with 8 respect to the 2009-2010 school taxes and the 2010 general taxes, for 9 the parcel of real property owned by such incorporated village located 10 in the town of North Hempstead, known on the Nassau County Land and Tax 11 Map as section 8, block A, lots 169A and 169C. If accepted, the applica- 12 tions shall be reviewed as if they had been received on or before the 13 taxable status date established for such rolls. 14 If satisfied that such incorporated village would otherwise be enti- 15 tled to such exemption if such incorporated village had filed an appli- 16 cation for exemption by the appropriate taxable status date, the county 17 assessor, upon approval by the Nassau county legislature, may grant 18 exemption from all taxation beginning with the date of acquisition of EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. If exemption is granted and 3 such incorporated village therefore shall have paid any tax with respect 4 to the subject roll, the governing body or tax department may, in its 5 sole discretion, provide for the refund of those taxes paid and cancel 6 taxes, fines, penalties, or interest remaining unpaid. 7 S 2. This act shall take effect immediately.
