STATE OF NEW YORK ________________________________________________________________________ 7307 2017-2018 Regular Sessions IN ASSEMBLY April 21, 2017 ___________ Introduced by M. of A. TITONE -- read once and referred to the Committee on Transportation AN ACT to amend the public authorities law, in relation to providing access to the E-ZPass program on applications for motor vehicle regis- trations The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 362 of the public authorities law, as amended by 2 section 9 of part TT of chapter 54 of the laws of 2016, is amended to 3 read as follows: 4 § 362. Assistance by state officers, departments, boards, divisions 5 and commissions. (a) At the request of the authority, engineering and 6 legal services for such authority shall be performed by forces or offi- 7 cers of the department of transportation and the department of law 8 respectively, and all other state officers, departments, boards, divi- 9 sions and commissions shall render services within their respective 10 functions. At the request of the authority, services in connection with 11 the collection of any charges or fees for the use of the thruway or any 12 part thereof may be performed by the department of motor vehicles. 13 (b) The department of motor vehicles shall include on all motor vehi- 14 cle registration applications, the opportunity for applicants to volun- 15 tarily participate in the E-ZPass program as prescribed by the authority 16 of motor vehicles. The purpose of such measure is to facilitate partic- 17 ipation in the E-ZPass program, therefore the department of motor vehi- 18 cles and the authority shall establish means by which the relevant 19 information may be shared to achieve such purpose. Participation in the 20 E-ZPass program shall be subject to the procedures, terms, conditions 21 and agreements as from time to time may be issued by the authority. Such 22 terms, conditions and agreements may include minimum deposits, adminis- 23 trative service fees on accounts or equipment, limits on transferability 24 and E-ZPass account requirements. LBD11000-01-7A. 7307 2 1 conditioned on continued compliance with requirements of other agencies 2 which operate the E-ZPass system. Unauthorized or improper use of an 3 E-ZPass tag or dedicated E-ZPass lane is prohibited and may result in 4 cancellation of E-ZPass account privilege and/or the imposition of 5 administrative fees, costs or penalties. 6 § 2. This act shall take effect on the ninetieth day after it shall 7 have become a law; provided, that the commissioner of motor vehicles is 8 immediately authorized and directed to promulgate, amend and/or repeal 9 any rules and regulations necessary to implement the provisions of this 10 act on its effective date.
