STATE OF NEW YORK ________________________________________________________________________ 7246 2023-2024 Regular Sessions IN ASSEMBLY May 15, 2023 ___________ Introduced by M. of A. WOERNER -- read once and referred to the Commit- tee on Libraries and Education Technology AN ACT to amend the education law, in relation to the award of grants to support preservation and/or conservation of library research materials The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraphs a and c of subdivision 6 of section 273 of the 2 education law, as amended by chapter 563 of the laws of 2021, are 3 amended to read as follows: 4 a. The commissioner shall award in any [state fiscal] academic year, 5 an annual formula grant of one hundred fifty-eight thousand dollars for 6 a program of conservation and/or preservation of library research mate- 7 rials to each of the following comprehensive research libraries: Colum- 8 bia university libraries, Cornell university libraries, New York state 9 library, New York university libraries, university of Rochester 10 libraries, Syracuse university libraries, the research libraries of the 11 New York public library, state university of New York at Albany library, 12 state university of New York at Binghamton library, state university of 13 New York at Buffalo library, and state university of New York at Stony 14 Brook library. 15 c. Other agencies and libraries, as defined in regulations promulgated 16 by the commissioner, which are not eligible for funding under paragraph 17 a of this subdivision, may receive separate grants the sum of which 18 shall not exceed five hundred thousand dollars in any [state fiscal] 19 academic year to support the preservation and/or conservation of unique 20 library research materials. Such agencies and libraries shall submit 21 project proposals. Approval of such project proposals, and determination 22 of funding level, shall be based upon, but not limited to, factors such 23 as: the research value of materials to be preserved and/or conserved; 24 appropriateness of conservation and preservation techniques in accord- 25 ance with statewide planning and national standards; institutional EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD11361-01-3A. 7246 2 1 capacity for successful completion of the project, including facilities, 2 experience, and technical expertise; availability of staff with appro- 3 priate training and expertise; contribution of the institution to the 4 project in matching funds and staff resources; and the volume of inter- 5 library lending and access to holdings by the public. Ninety percent of 6 each such grant shall be payable upon approval by the department and the 7 remaining ten percent shall be payable upon project completion. 8 § 2. This act shall take effect immediately.
