PALMES- ANO -- read once and referred to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to excluding certain programs from the definition of summer day camp for the year 2011 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 2 of section 1392 of the public health law, as 2 amended by chapter 439 of the laws of 2009, is amended to read as 3 follows: 4 2. "Summer day camp" shall mean a property consisting of a tract of 5 land and any tents, vehicles, buildings or other structures that may be 6 pertinent to its use, any part of which may be occupied on a scheduled 7 basis at any time between June first and September fifteenth in any year 8 by children under sixteen years of age under general supervision, for 9 the purpose of indoor or outdoor organized group activities, involving 10 nonpassive recreational activities with significant risk of injury, as 11 such activities are defined by the department in rules and regulations, 12 for a period of less than twenty-four hours on any day the property is 13 so occupied, and on which no provisions are made for overnight occupancy 14 by such children; PROVIDED, HOWEVER, THAT SUMMER DAY CAMP SHALL NOT 15 INCLUDE ANY SUMMER DAY CAMP RUN BY A TOWN, VILLAGE OR OTHER GOVERNMENTAL 16 ENTITY IN THE YEAR TWO THOUSAND ELEVEN UNLESS SUCH SUMMER DAY CAMP HAD 17 BEEN PERMITTED ACCORDINGLY BY THE DEPARTMENT AND DEEMED TO BE A SUMMER 18 DAY CAMP PRIOR TO APRIL FIRST, TWO THOUSAND ELEVEN. The commissioner 19 shall have the power to except by rule from this article and the sani- 20 tary code a place, facility or activity that is not within the intent of 21 this definition. 22 S 2.
